1Short title

This regulation may be cited as the Planning Amendment Regulation 2026.

This regulation amends the Planning Regulation 2017.

Division 9 Transitional provisions for Planning Amendment Regulation 2026

86Particular existing development applications and change applications

(1)This section applies in relation to the following applications—
(a)a development application that was properly made, but not decided, before the commencement;
(b)a change application that was properly made, but not decided, before the commencement;
(c)a change application made after the commencement if the application is for a change to a development approval—
(i)given before the commencement; or
(ii)given after the commencement for an application mentioned in paragraph (a) or (b).
(2)This regulation applies in relation to the application as if the Planning Amendment Regulation 2026, sections 4 to 7 and 8(2) had not commenced.
(3)For this section, a change application is properly made if—
(a)the application complies with section 79(1) to (3) of the Act; or
(b)the responsible entity for the application accepts the application under section 79(4)(c) or (d) of the Act.

87Existing development applications involving particular development

(1)This section also applies in relation to a development application that was properly made, but not decided, before the commencement to the extent the application involves development stated in—
(a)former schedule 10, part 9, division 1; or
(b)former schedule 10, part 18.
(2)The following provisions continue to apply in relation to the development application—
(a)former schedule 10;
(b)former schedule 24.
(3)In this section—
former, in relation to a provision of this regulation, means the provision as in force from time to time before the commencement.
