Coastal Protection and Management and Other Legislation Amendment Regulation 2026

1Short title

This regulation may be cited as the Coastal Protection and Management and Other Legislation Amendment Regulation 2026.

2Regulation amended

This part amends the Coastal Protection and Management Regulation 2017.

3Replacement of s 14 (Requirements for accepted development—Act, s 167)

Section 14—
omit, insert—

14Requirements for accepted development—Act, s 167

(1)This section applies to operational work stated in the Planning Regulation 2017, schedule 7, section 10(a).

(2)For section 167(5)(b) of the Act, the operational work must—

(a)be undertaken by an entity to which the coastal management accepted development code applies; and

(b)comply with the coastal management accepted development code.

(3)In this section—

coastal management accepted development code means the document called ‘Code for accepted development—For tidal works, or work completely or partly in a coastal management district’ dated January 2026 and published on the department’s website.

4Regulation amended

This part amends the Planning Regulation 2017.

5Amendment of sch 7 (Accepted development)

Schedule 7, section 10(b) and (c)—
omit, insert—

(b)complies with the requirements for the work prescribed under the Coastal Act, section 167(5)(b).
