(a)be undertaken by an entity to which the coastal management accepted development code applies; and

(b)comply with the coastal management accepted development code.

(3)In this section—coastal management accepted development code means the document called ‘Code for accepted development—For tidal works, or work completely or partly in a coastal management district’ dated January 2026 and published on the department’s website.Part 3Amendment of Planning Regulation 20174Regulation amendedThis part amends the Planning Regulation 2017.5Amendment of sch 7 (Accepted development)Schedule 7, section 10(b) and (c)—omit, insert—

(b)complies with the requirements for the work prescribed under the Coastal Act, section 167(5)(b).Note—See the Coastal Regulation, section 14.
