1Matters for which fees are payable

(1)Section 6 states the fees payable if—(a)the owner or master of a ship—(i)has arranged pilotage for the ship with a harbour master; and(ii)has not given the harbour master notice of an amendment or cancellation of the pilotage under section 3; and(b)the pilotage for the ship is delayed for longer than 30 minutes, but not longer than 2 hours, after the time arranged for the pilotage with the harbour master.(2)The fee payable is—(a)if pilotage for the ship is delayed for longer than 30 minutes but not longer than 1 hour—the fee stated in section 6; or(b)if pilotage for the ship is delayed for longer than 1 hour but not longer than the cancellation period—the fee stated in section 6 for each hour, or part of an hour, the ship is delayed.(3)If pilotage for the ship is delayed for longer than the cancellation period—(a)the pilotage is taken to have been cancelled; and(b)a cancellation fee under division 2 is payable.(4)In this section—cancellation period means a delay of longer than—(a)if the general manager considers a period of longer than 2 hours is necessary for the effective and efficient operation of the pilotage service in a pilotage area—the period stated by the general manager by gazette notice for the pilotage area; or(b)otherwise—2 hours.delay does not include delay caused by weather affecting a ship’s ability to be safely navigated.
