Part 1 Preliminary

1Short title

This regulation may be cited as the Disability Services (Transitional) Regulation 2019.

2Commencement

This regulation commences on 1 July 2019.

3Declaration that regulation is a transitional regulation—Act, s 366

This regulation is a transitional regulation.

Note—

Under section 366(5) of the Act, this regulation expires 3 years after the day of commencement of section 366 of the Act.

4Definition

In this regulation—
pre-amended Act means the Disability Services Act 2006 as in force immediately before 1 July 2019.

Part 2 Complaints

5Complaints made before 1 July 2019

Part 3 of the Act continues to apply in relation to a complaint made, before 1 July 2019, to the chief executive under the pre-amended Act, section 33(1), even if the complaint may not be made under section 33(1) of the Act on or after 1 July 2019.

6Particular complaints may be made to chief executive after 1 July 2019

(1)This section applies in relation to a complaint by a person if—
(a)the person could have, under the pre-amended Act, section 33(1), made the complaint; and
(b)immediately before 1 July 2019, the complaint had not been made; and
(c)the complaint may not be made under section 33(1) of the Act.
(2)Despite section 33(1) of the Act, the person may make the complaint to the chief executive if the complaint relates to a matter arising before 1 July 2019.
(3)Part 3 of the Act applies in relation to the complaint as if the complaint were made under section 33(1) of the Act.
