Retail Shop Leases (Transitional) Regulation 2016

1Short title

This regulation may be cited as the Retail Shop Leases (Transitional) Regulation 2016.

2Commencement

This regulation is taken to have commenced on 25 November 2016.

3Declaration that regulation is a transitional regulation—Act, s 153

This regulation is a transitional regulation.

Note—

Under section 153(4) of the Act, this regulation expires 1 year after the commencement of that section.

4Particular leases continue to be retail shop leases

(1)This section applies in relation to a lease of premises if—

(a)immediately before the commencement, the lease was a retail shop lease; and

(b)but for subsection (2), the lease would not be a retail shop lease under section 5A(2)(a) or (c) of the Act.

(2)Despite section 5A(2)(a) or (c) of the Act, on and after the commencement, the lease is taken to continue to be a retail shop lease under the Act.
