s1 3 s3 State Financial Institutions and Metway Merger Facilitation (Transitional-Transfer of Assets and Liabilities) Regulation 1996 STATE FINANCIAL INSTITUTIONS AND METWAY MERGER FACILITATION (TRANSITIONAL-TRANSFER OF ASSETS AND LIABILITIES) REGULATION 1996 [reprinted as in force on 6 December 1996] ˙ Short title 1. This regulation may be cited as the State Financial Institutions and Metway Merger Facilitation (Transitional–Transfer of Assets and Liabilities) Regulation 1996 . ˙ Application of regulation 2. This regulation applies if, under the Metway scheme of arrangement, an asset or liability of Suncorp Holdings Limited (A.C.N. 075 679 033) ( “SHL” ) is transferred to Metway. 1 ˙ Relationship between customers of SHL and Metway 3. The relationship existing between SHL and a person (including a customer of SHL) in relation to the asset or liability immediately before the Metway amalgamation day 2 continues between Metway and the person on and from the Metway amalgamation day and gives rise to the same rights (including rights of set-off) and the same liabilities as would have arisen if there had been no transfer. 1 Suncorp Holdings Limited was formerly Suncorp Building Society Limited. 2 The Metway amalgamation day is 1 December 1996 (see notice pubd gaz 29 November 1996 p 1257).

s4 4 s5 State Financial Institutions and Metway Merger Facilitation (Transitional-Transfer of Assets and Liabilities) Regulation 1996 ˙ Instructions to or by SHL and information about customers 4.(1) An instruction, order, mandate, authority or notice given to or by SHL before the Metway amalgamation day is, so far as it is referable to the asset or liability, taken to have been given to or by Metway. (2) Metway is entitled to possession of, and use of information contained in, all documents to which SHL was entitled immediately before the Metway amalgamation day that are referable to the asset or liability. ˙ Expiry 5. Under section 94(2)(b) of the Act, this regulation expires 12 months after it commences.
