Witness Protection Regulation 2021

1Short title

This regulation may be cited as the Witness Protection Regulation 2021.

2Commencement

This regulation commences on 1 September 2021.

3Definitions

The dictionary in schedule 1 defines particular words used in this regulation.

4Approved authorities—Act, sch 2, definition approved authority

For schedule 2 of the Act, definition approved authority, paragraph (c)(iii), each of the following entities is declared to be an approved authority, but only in relation to section 43 of the Act—
(a)ACT Integrity Commission;
(b)Australian Crime Commission;
(c)Corruption and Crime Commission;
(d)Independent Broad-based Anti-corruption Commission;
(e)Independent Commission Against Corruption;
(f)Independent Commissioner Against Corruption (NT);
(g)Independent Commissioner Against Corruption (SA);
(h)Integrity Commissioner;
(i)Law Enforcement Conduct Commission;
(j)New South Wales Crime Commission.

5Complementary witness protection laws—Act, sch 2, definition complementary witness protection law

For schedule 2 of the Act, definition complementary witness protection law, each of the following laws is declared to be a complementary witness protection law—
(a)Witness Protection Act 1991 (Vic);
(b)Witness Protection Act 1994 (Cwlth);
(c)Witness Protection Act 1995 (NSW);
(d)Witness Protection Act 1996 (ACT);
(e)Witness Protection Act 1996 (SA);
(f)Witness Protection Act 2000 (Tas);
(g)Witness Protection (Northern Territory) Act 2002 (NT);
(h)Witness Protection (Western Australia) Act 1996 (WA).

6Law enforcement agencies—Act, sch 2, definition law enforcement agency

For schedule 2 of the Act, definition law enforcement agency, paragraph (g), each of the following entities is declared to be a law enforcement agency—
(a)ACT Integrity Commission;
(b)Australian Crime Commission;
(c)Corruption and Crime Commission;
(d)Independent Broad-based Anti-corruption Commission;
(e)Independent Commission Against Corruption;
(f)Independent Commissioner Against Corruption (NT);
(g)Independent Commissioner Against Corruption (SA);
(h)Integrity Commissioner;
(i)Law Enforcement Conduct Commission;
(j)New South Wales Crime Commission.

7Repeal

The Witness Protection Regulation 2011, SL No. 159 is repealed.

Schedule 1 Dictionary

section 3

ACT Integrity Commission means the ACT Integrity Commission under the Integrity Commission Act 2018 (ACT).
Australian Crime Commission means the Australian Crime Commission under the Australian Crime Commission Act 2002 (Cwlth).
Corruption and Crime Commission means the Corruption and Crime Commission under the Corruption, Crime and Misconduct Act 2003 (WA).
Independent Broad-based Anti-corruption Commission means the Independent Broad-based Anti-corruption Commission under the Independent Broad-based Anti-corruption Commission Act 2011 (Vic).
Independent Commission Against Corruption means the Independent Commission Against Corruption under the Independent Commission Against Corruption Act 1988 (NSW).
Independent Commissioner Against Corruption (NT) means the Independent Commissioner Against Corruption under the Independent Commissioner Against Corruption Act 2017 (NT).
Independent Commissioner Against Corruption (SA) means the Independent Commissioner Against Corruption under the Independent Commissioner Against Corruption Act 2012 (SA).
Integrity Commissioner means the Integrity Commissioner under the Law Enforcement Integrity Commissioner Act 2006 (Cwlth).
Law Enforcement Conduct Commission means the Law Enforcement Conduct Commission under the Law Enforcement Conduct Commission Act 2016 (NSW).
New South Wales Crime Commission means the New South Wales Crime Commission under the Crime Commission Act 2012 (NSW).
