Part 1 Preliminary

1Short title

This regulation may be cited as the Health Legislation (COVID-19 Emergency Response) Regulation 2020.

2Commencement

Section 13 is taken to have commenced on 19 March 2020.

3Declaration that regulation is made under COVID-19 Emergency Response Act 2020, s 13

This regulation is made under the COVID-19 Emergency Response Act 2020, section 13.

4Period not extended beyond the COVID-19 legislation expiry day

(1)This section applies if a period extended under this regulation would, but for this section, end on a day that is after the COVID-19 legislation expiry day.
(2)The period is taken to end on the COVID-19 legislation expiry day.

Part 2 Modification of Food Act 2006

5Application of part

(1)This part provides for modifying particular periods under the Food Act 2006.
(2)In this part—
(a)a reference to the Act is a reference to the Food Act 2006; and
(b)a reference to an application is a reference to an application—
(i)made, but not decided, before the commencement; or
(ii)made after the commencement.

6Period for requesting further information or document for application for licence—Act, s 59

(1)This section applies in relation to an application for a licence made to a local government if the local government has, under the COVID-19 Emergency Response Act 2020, section 12(3)(a) or (b), modified the period mentioned in section 61(1) of the Act for the application.
(2)Section 59 of the Act applies in relation to the application as if the reference in section 59(3) of the Act to 30 days were a reference to the modified period.

7Period for deciding application for renewal, restoration or amendment of licence—Act, s 77

Section 77 of the Act applies in relation to an application for renewal, restoration or amendment of a licence as if each reference in the section to 30 days were a reference to 90 days.

8Period for requesting further information or document for application for approval as auditor—Act, s 132

(1)This section applies in relation to an application for approval as an auditor if the chief executive has, under the COVID-19 Emergency Response Act 2020, section 12(3)(a) or (b), modified the period mentioned in section 134(1) of the Act for the application.
(2)Section 132 of the Act applies in relation to the application as if the reference in section 132(3) of the Act to 30 days were a reference to the modified period.

9Period for deciding application for amendment of conditions of auditor’s approval—Act, s 143

Section 143 of the Act applies in relation to an application for the amendment of the conditions of an auditor’s approval as if each reference in the section to 30 days were a reference to 90 days.

10Period for deciding application for compensation—Act, s 220

Section 220 of the Act applies in relation to an application for compensation as if the reference in section 220(4) of the Act to 28 days were a reference to 90 days.

11Period for giving QCAT information notice of review decision—Act, s 239

Section 239 of the Act applies in relation to an application for review of an original decision as if the references in section 239(4) of the Act to 30 days and 30th day were references to 90 days and 90th day.

Part 3 Modification of Pest Management Act 2001

12Application of part

(1)This part provides for modifying particular periods under the Pest Management Act 2001.
(2)In this part—
(a)a reference to the Act is a reference to the Pest Management Act 2001; and
(b)other than in section 13, a reference to an application is a reference to an application—
(i)made, but not decided, before the commencement; or
(ii)made after the commencement.

13Application for renewal of expired licence—Act, s 29

(1)Despite section 29(1) and (2) of the Act, a pest management technician whose licence expires after the commencement may apply for renewal of the licence within 30 days after the licence expires.
(2)However, the chief executive may accept and decide the application only if the chief executive is satisfied it is reasonable to do so having regard to the main purposes of the COVID-19 Emergency Response Act 2020.
(3)If the chief executive accepts the application under subsection (2), the period before the licence expires is extended, and taken to have always been extended, until any of the following happens—
(a)a new licence is issued to the technician;
(b)the application is withdrawn;
(c)an information notice for the application is given to the technician under section 31(4) of the Act.

14Period for giving QCAT information notice for review decision—Act, s 106

Section 106 of the Act applies in relation to an application for review of an original decision as if the reference in section 106(4) of the Act to 60 days were a reference to 90 days.

Part 4 Expiry of regulation

15Expiry

This regulation expires on the COVID-19 legislation expiry day.
