State Buildings Protective Security Regulation 2008

1Short title

This regulation may be cited as the State Buildings Protective Security Regulation 2008.

2Definitions

The dictionary in schedule 2 defines particular words used in this regulation.

3Declaration of the Queensland Cultural Centre as state buildings—Act, s 4(4)

(1)For section 4(4) of the Act, the buildings and their precincts located on the land described in schedule 1, part 1 are state buildings.

(2)This section expires on 31 August 2020.

3ADeclaration of Legal Aid Queensland offices as state buildings—Act, s 4(4)

(1)For section 4(4) of the Act, the following are state buildings—

(a)the buildings and their precincts located on the land described in schedule 1, part 2, item 1;

(b)the part of the building, located on the land described in schedule 1, part 2, item 2, that is the subject of registered leases GA, GE and G2 under the Land Title Act 1994 and the precincts of the building located on that land.

(2)This section expires on 31 August 2020.

4Security officers to serve in state buildings as directed

A security officer must serve in any state building in which the commissioner directs the officer to serve.

5Standards of physique and physical fitness for security officers—Act, s 9(2)

(1)The standard of physique and state of physical fitness for protective security officers is a physique suitable, and level of physical fitness appropriate, for performing the functions of a protective security officer.

(2)The standard of physique and state of physical fitness for senior protective security officers is a physique suitable, and level of physical fitness appropriate, for performing the functions of a senior protective security officer.

6Uniforms

The uniform for a security officer is the uniform decided for the officer by the commissioner.

7Surrender of uniforms—Act, s 30(1)(c)

For section 30(1)(c) of the Act, a security officer’s uniform is a prescribed thing.

8Hand over of duties

(1)A security officer (the duty officer) performing the duty officer’s functions in a state building must remain on duty in the building until—

(a)relieved of duty by another security officer; or

(b)authorised by the commissioner to leave the building.

(2)However, the duty officer may leave the building if it is necessary for performing the duty officer’s functions.

9Emergency duties

A security officer must take up duty promptly in an emergency, if directed by the commissioner, unless the security officer has a reasonable excuse.

10Security officers on duty not to be under the influence of liquor or a drug

(1)This section applies to a security officer who is on duty.

(2)The security officer must not be under the influence of liquor or a drug to the extent the security officer is not fit to perform the security officer’s functions.

11Security officers in uniform not to obtain liquor

(1)A security officer in uniform must not obtain liquor from licensed premises.

(2)Subsection (1) does not apply if—

(a)the security officer obtains the liquor in a motor vehicle; and

(b)the motor vehicle is not a motor vehicle used to provide services for the security of state buildings; and

(c)the liquor is in a sealed container; and

(d)the security officer leaves the licensed premises immediately after obtaining the liquor.

12Security officers in uniform not to enter or remain on licensed premises

(1)A security officer in uniform must not enter licensed premises or remain on licensed premises.

(2)Subsection (1) does not apply if—

(a)the security officer enters or remains on licensed premises to perform the security officer’s functions; or

(b)the security officer enters or remains on licensed premises under section 11(2).

13Repeal

The State Buildings Protective Security Regulation 1998, SL No. 98 is repealed.
