1Short title

This regulation may be cited as the Major Events (Motor Racing Events) Regulation 2015.

2Definitions

In this regulation—

Gold Coast 600 means the major event prescribed under section 9.

motor racing event means—

(a)the Gold Coast 600; or

(b)the Townsville 400.

Townsville 400 means the major event prescribed under section 3.

3Townsville 400 is a major event

For section 12(1) of the Act, the V8 Supercars motor racing event known as the Townsville 400 to be held in 2018 is a major event.

4Major event organiser for Townsville 400

For section 12(2)(a) of the Act, V8 Supercars Australia Pty Ltd ACN 077 053 484 is the major event organiser for the Townsville 400.

5Major event area for Townsville 400

For section 12(2)(b) of the Act, the major event area for the Townsville 400 is the area surrounding the Townsville Civic Theatre shown on the map in schedule 1 as the major event area.

6Major event period for Townsville 400

For section 12(2)(c) of the Act, the major event period for the Townsville 400 is the period between midday on Thursday 5 July 2018 and midday on Monday 9 July 2018.

7Carrying out temporary works for Townsville 400

For section 16(2) of the Act, the following periods, dates inclusive, are prescribed—

(a)between 28 May 2018 and midday on 5 July 2018;

(b)between midday on 9 July 2018 and 28 July 2018.

8Declaration of official title for Townsville 400

For section 51(1)(b) of the Act, the title ‘2018 Watpac Townsville 400’ is declared an official title for the Townsville 400.

9Gold Coast 600 is a major event

For section 12(1) of the Act, the V8 Supercars motor racing event known as the Gold Coast 600 to be held in 2018 is a major event.

11Major event area for Gold Coast 600

For section 12(2)(b) of the Act, the following areas shown on the map in schedule 2 are the major event areas for the Gold Coast 600—

(a)the areas surrounding McIntosh Island Park in Surfers Paradise;

(b)the areas in the Southport Broadwater Parklands;

(c)3332 Surfers Paradise Boulevard, Surfers Paradise.

12Major event period for Gold Coast 600

For section 12(2)(c) of the Act, the major event period for the Gold Coast 600 is the period between midday on 18 October 2018 and midday on 22 October 2018.

For section 16(2) of the Act, the following periods, dates inclusive, are prescribed—

(a)between 10 September 2018 and midday on 18 October 2018;

(b)between midday on 22 October 2018 and 10 November 2018.

For section 51(1)(b) of the Act, the title ‘2018 Vodafone Gold Coast 600’ is declared an official title for the Gold Coast 600.

15Application of Act provisions to motor racing events

For sections 17 and 55 of the Act, the following provisions of the Act are prescribed, under section 12(2)(d) of the Act, to apply to a motor racing event and the major event area for the major event period—

(a)sections 18(1) to (4), (6), (7) and (9), 19 to 28, 31, 36 and 40;

(b)part 6.

16Display of poster prescribed prohibited conduct

(1)For section 20(6)(h) of the Act, displaying a poster on a property inside the major event area for a motor racing event, including on the outside of a building or structure, is prescribed.

(2)Subsection (1) does not apply to a poster displayed by a person if the poster—

(a)was displayed before the major event period for the motor racing event; and

(b)was displayed in the course of the person’s ordinary activities.

17Persons who may be appointed as authorised persons

For section 56(1)(d) of the Act, crowd controllers under the Security Providers Act 1993 are prescribed for a motor racing event.

18Limitation on particular authorised person’s powers

(1)This section limits, for section 57(2) of the Act, the powers of particular authorised persons for a motor racing event.

(2)The powers of an authorised person who is not a police officer do not include the powers stated in sections 25, 54, 63 and 65 of the Act.

19Application of laws to roads

For section 80(1)(b) of the Act, each road shown in the major event area for a motor racing event shown on the map in schedule 1 or 2 ceases to be a road for the major event period for the event.

20Assessing building work

(1)This section applies to a building certifier engaged to assess building work for the purpose of giving a compliance certificate for section 78(3) of the Act.

(2)Before giving a compliance certificate for the building work, the building certifier must—

(a)consult the Queensland Fire and Emergency Service about a special fire service or any work involving a fire-related alternative solution for the building work; and

(b)if the building work is for a building or structure that is proposed to have a special fire service or involves a fire-related alternative solution—obtain and consider a report from the Queensland Fire and Emergency Service on the suitability of the proposed special fire service or fire-related alternative solution.

(3)In this section—

building certifier see the Building Act 1975, section 8.

building work see the Building Act 1975, section 5.

fire-related alternative solution means an alternative solution as defined under the Building Act 1975, schedule 2 for performance requirements relating to fire safety.

performance requirements see the Building Act 1975, schedule 2.

special fire service see the Building Act 1975, schedule 2.
