Public Records Regulation 2014

1Short title

This regulation may be cited as the Public Records Regulation 2014.

2Relevant public authority—Act, s 8(3)(b)

(1)This section applies if a public authority (the column 1 public authority) mentioned in schedule 1, column 1 ceases to exist.

(2)For section 8(3)(b) of the Act, the public authority mentioned in schedule 1, column 2 shown opposite the column 1 public authority is the relevant public authority for the column 1 public authority.

3Responsible public authority—Act, s 15

(1)For section 15(d) of the Act, the department in which the Commissions of Inquiry Act 1950 is administered is prescribed as the responsible public authority for a public record of each of the following public authorities that has ceased to exist—

(a)the commission established under the Commissions of Inquiry Order (No. 1) 2011;

(b)the commission established under the Commissions of Inquiry Order (No. 1) 2012;

(c)the commission established under the Commissions of Inquiry Order (No. 2) 2012;

(d)the commission established under the Commissions of Inquiry Order (No. 1) 2013;

(e)the commission established under the Commissions of Inquiry Order (No. 1) 2015;

(f)the commission established under the Commissions of Inquiry Order (No. 4) 2015;

(g)the commission established under the Commissions of Inquiry Order (No. 1) 2016.

1The commission of inquiry mentioned in paragraph (a) is known as the Queensland Floods Inquiry.

2The commission of inquiry mentioned in paragraph (b) is known as the Queensland Child Protection Commission of Inquiry.

3The commission of inquiry mentioned in paragraph (c) is known as the Queensland Health Payroll System Commission of Inquiry.

4The commission of inquiry mentioned in paragraph (d) is known as the Queensland Racing Commission of Inquiry.

5The commission of inquiry mentioned in paragraph (e) is known as the Queensland Organised Crime Commission of Inquiry.

6The commission of inquiry mentioned in paragraph (f) is known as the Barrett Adolescent Centre Commission of Inquiry.

7The commission of inquiry mentioned in paragraph (g) is known as the Independent Review of Youth Detention.

(2)For section 15(d) of the Act, the department in which the Racing Act 2002 is administered is prescribed as the responsible public authority for a public record of the commission established under the Commissions of Inquiry Order (No. 2) 2015.

The commission of inquiry mentioned in subsection (2) is known as the Queensland Greyhound Racing Industry Commission of Inquiry.

(3)For section 15(d) of the Act, the department in which the Constitution of Queensland 2001 is administered is prescribed as the responsible public authority for a public record of each of the following public authorities that has ceased to exist—

(a)the commission established under the Commissions of Inquiry Order (No. 3) 2015;

(b)the commission established under the Commissions of Inquiry Order (No. 2) 2016.

2The commission of inquiry mentioned in paragraph (b) is known as the Queensland Rail Train Crewing Practices Commission of Inquiry.

(4)For section 15(d) of the Act, the department in which the Sugar Industry Act 1999 is administered is prescribed as the responsible public authority for a public record of the Bureau of Sugar Experiment Stations that has ceased to exist.

(5)For section 15(d) of the Act, the department in which the Transport Infrastructure Act 1994 is administered is prescribed as the responsible public authority for a public record of the Port of Brisbane Corporation Limited ACN 124 048 522 that has ceased to exist.

(6)For section 15(d) of the Act, the department in which the Local Government Act 2009 is administered is prescribed as the responsible public authority for a public record of the Local Government Association of Queensland (Incorporated), established under the repealed Local Government Act 1993, that has ceased to exist.

4Repeal

The Public Records Regulation 2004, SL No. 136 is repealed.
