Cremations Regulation 2014

1Short title

This regulation may be cited as the Cremations Regulation 2014.

2Commencement

This regulation commences on 1 September 2014.

3Labelling ashes

For section 11(1)(a) of the Act, the following requirements are prescribed—
(a)a label must be securely attached to the exterior of each container in which the ashes are stored;
(b)the label must be legible;
(c)the label must include the following information—
(i)the deceased person’s name;
(ii)if the person in charge of the crematorium has been given the deceased person’s date of death—the date of death;
(iii)the cremation date;
(iv)the name and address of the crematorium;
(v)if the person in charge of the crematorium has allocated a number for the cremation for the purpose of identifying the cremation—the number;
(d)if the deceased person’s ashes are stored in more than 1 container, each label must—
(i)be consecutively numbered; and
(ii)state the total number of containers in which the deceased person’s ashes are stored.

Example for paragraph (d)—

A deceased person’s ashes are stored in 2 containers. The label for 1 container includes the words ‘No. 1 of 2’ and the label for the other container includes the words ‘No. 2 of 2’.

4Prescribed particulars for record of cremation

For section 14(1)(a) of the Act, the following particulars, to the extent they are given to the person in charge of the crematorium, are prescribed—
(a)the deceased person’s name;
(b)the deceased person’s age at death;
(c)the date and place of the death;
(d)the deceased person’s usual, or last known, place of residence;
(e)the cremation date;
(f)the date the permission to cremate was issued by the coroner or independent doctor;
(g)the following particulars about how the ashes were disposed of—
(i)if the ashes were dealt with under section 11(1)(b) of the Act
(A)the details of the applicant’s instructions; and
(B)the date and way in which the instructions were carried out;
(ii)if the ashes were dealt with under section 11(2) of the Act
(A)the date the notice under section 11(3) of the Act was given to the applicant; and
(B)the date and place of burial.

5Repeal

The Cremations Regulation 2003, SL No. 287 is repealed.
