An Act to amend the Liquid Fuel Supply Act 1984 for particular purposes
The Parliament of Queensland enacts—
This Act may be cited as the Liquid Fuel Supply (Ethanol and Other Biofuels Mandate) Amendment Act 2026.
This Act commences on the day that is 1 year after the date of assent.
This Act amends the Liquid Fuel Supply Act 1984.
4Amendment of s 35A (Application of div 1)
(1)Section 35A(2), from ‘of—’—
omit, insert—of petrol fuel or diesel fuel by a fuel wholesaler to another fuel wholesaler.
(2)Section 35A(3) and (5)—
omit.(3)Section 35A(4)—
renumber as section 35A(3).
5Amendment of s 35B (Sustainable biobased petrol requirement)
(1)Section 35B(2), penalty—
omit, insert—Maximum penalty—
(a)for a first offence—400 penalty units; or(b)for a second or later offence—4,000 penalty units.(2)Section 35B(3), definition minimum amount, paragraph (b)—
omit.(3)Section 35B(3), definition minimum amount, paragraph (c)—
renumber as paragraph (b).
6Amendment of s 35C (Sustainable biobased diesel requirement)
Section 35C(2), penalty—
omit, insert—Maximum penalty—

35DA Definitions for subdivision
In this subdivision—% v/v means per cent volume by volume.E10 means a petrol-biobased petrol blend that is sold, marketed or represented as ‘E10’.35DB Biobased petrol content in petrol-biobased petrol blends
A fuel seller must not sell a petrol-biobased petrol blend unless the percentage of biobased petrol in the blend is at least—(a)for E10—9% v/v; or(b)for another petrol-biobased petrol blend—1% v/v.Maximum penalty—
(a)for a first offence—400 penalty units; or(b)for a second or later offence—4,000 penalty units.35DC Biobased diesel content in diesel-biobased diesel blends
A fuel seller must not sell a diesel-biobased diesel blend unless the percentage of biobased diesel in the blend is at least 2% v/v.Maximum penalty—
(a)for a first offence—400 penalty units; or(b)for a second or later offence—4,000 penalty units.35DD Defence for offence against s 35DB or 35DC
(1)In a proceeding for an offence against section 35DB or 35DC (the relevant section), it is a defence for the person charged with the offence to prove that the person took all reasonable steps to prevent the offence.(2)When deciding whether the person took all reasonable steps to prevent the offence, the court may consider the following—(a)any system the person established and maintained to ensure the person was complying with the relevant section;(b)any training the person required their employees to undertake to ensure the person was complying with the relevant section;(c)any testing the person carried out to assess whether the person was complying with the relevant section;(d)any records the person kept to demonstrate the person was complying with the relevant section.35DE Display of octane rating for E10
(1)A fuel retailer must not sell E10 unless the fuel retailer displays the octane rating for the E10 in the way stated in subsection (2).Maximum penalty—
(a)for a first offence—400 penalty units; or(b)for a second or later offence—4,000 penalty units.(2)For each E10 fuel pump, the octane rating for the E10 must be displayed in 1 or more places on the fuel pump in a way that is likely to be seen by—(a)a person approaching the fuel pump in a vehicle; and(b)a person dispensing fuel from the fuel pump.(3)In this section—E10 fuel pump means a fuel pump, at a service station, that is used by the fuel retailer mentioned in subsection (1) to sell E10 to the public, whether or not the pump is also used for another purpose.octane rating, for E10, means the research octane number for the E10, rounded down to the next whole number.
