Drugs Misuse Amendment Regulation 2026

1Short title

This regulation may be cited as the Drugs Misuse Amendment Regulation 2026.

2Regulation amended

This regulation amends the Drugs Misuse Regulation 1987.

3Amendment of sch 2 (Dangerous drugs)

(1)Schedule 2, entry for 1,4-Butanediol—
omit, insert—

1,4-Butanediol unless a person carries on the business of trafficking in the thing, or possesses, produces or supplies the thing, or publishes instructions or has possession of a document containing instructions about the way to produce the thing—

(a)for a legitimate industrial activity or purpose; or

(b)for a legitimate commercial activity or purpose directly related to a legitimate industrial activity or purpose.

(2)Schedule 2, entry for 4-Hydroxybutanoic acid lactone—
omit, insert—

4-Hydroxybutanoic acid lactone unless a person carries on the business of trafficking in the thing, or possesses, produces or supplies the thing, or publishes instructions or has possession of a document containing instructions about the way to produce the thing—

(a)for a legitimate industrial activity or purpose; or

(b)for a legitimate commercial activity or purpose directly related to a legitimate industrial activity or purpose.

4Amendment of sch 6 (Controlled substances)

(1)Schedule 6—
insert—

1,4-Butanediol only if a person attempts to obtain the substance from someone else under a relevant transaction, obtains the substance from someone else under a relevant transaction, owns the substance, has possession of the substance for the purpose of supplying the substance under a relevant transaction, or supplies the substance under a relevant transaction—

(a)for a legitimate industrial activity or purpose; or

(b)for a legitimate commercial activity or purpose directly related to a legitimate industrial activity or purpose.

(2)Schedule 6—
insert—

4-Hydroxybutanoic acid lactone only if a person attempts to obtain the substance from someone else under a relevant transaction, obtains the substance from someone else under a relevant transaction, owns the substance, has possession of the substance for the purpose of supplying the substance under a relevant transaction, or supplies the substance under a relevant transaction—

(a)for a legitimate industrial activity or purpose; or

(b)for a legitimate commercial activity or purpose directly related to a legitimate industrial activity or purpose.
