Major Sports Facilities Regulation 2026

1Short title

This regulation may be cited as the Major Sports Facilities Regulation 2026.

2Definitions

In this regulation—

operational management plan see schedule 2, section 4(1).

operator means the person who operates the major sports facility called Brisbane Stadium (Lang Park) for the Authority under an agreement between the person and the Authority.

Stadium Management Advisory Committee means the committee of that name established in accordance with the relevant development approval.

stage and seating plan see schedule 2, section 8(2).

transport management plan see schedule 2, section 3(1).

3Major sports facilities—Act, s 4

For section 4(1) of the Act, each facility mentioned in schedule 1, column 1 continues to be declared to be a major sports facility.

4Crowd size for major sport event—Act, s 30AL

For section 30AL of the Act, definition major sport event, the number prescribed is 45,000.

5Use of Brisbane Stadium (Lang Park) for particular special events—Act, s 30A

(1)For section 30A(1) of the Act, each of the following special events is prescribed for the major sports facility called Brisbane Stadium (Lang Park)—

(a)a major concert—

(i)that is not more than the 12th major concert to be held at the major sports facility in a calendar year; and

(ii)for which the use of the major sports facility is approved by the Minister;

(b)a religious event—

(i)that is the only religious event to be held at the major sports facility in a calendar year; and

(ii)for which the use of the major sports facility is approved by the Minister.

(2)For section 30A(5) of the Act, the conditions stated in schedule 2 are prescribed for each special event prescribed under subsection (1).

(3)For the calendar year starting on 1 January 2026, this section applies as if the reference in subsection (1)(a)(i) to the 12th major concert were a reference to the 21st major concert.

(4)This subsection and subsection (3) expire on 1 January 2027.

6Prescribed event for particular restrictions on advertising—Act, s 30D

For section 30D of the Act, definition prescribed event, paragraphs (a), (b) and (c), the matters prescribed are that the major sports facility event—

(a)is an event for which entry tickets are issued; and

(b)is organised, scheduled or endorsed by a national or international body stated in schedule 3, column 1; and

(c)is held at a major sports facility stated opposite the national or international body in schedule 3, column 2.

7Repeal

The Major Sports Facilities Regulation 2014, SL No. 152 is repealed.

8Definitions for division

In this division—

new, in relation to a provision of this regulation, means the provision of this regulation as in force from the commencement.

repealed regulation means the repealed Major Sports Facilities Regulation 2014.

9Conditions on use of Brisbane Stadium (Lang Park)— transport management plan and operational management plan

(1)Despite section 5(2), new schedule 2 applies in relation to the transitional period with the modifications provided under this section.

(2)New schedule 2, sections 3 and 4 apply to the operator as if the reference in sections 3(1) and 4(1) of that schedule to the operator must prepare a plan were a reference to the operator may prepare a plan.

(3)However, until the operator prepares a plan under a new provision mentioned in column 1 of the following table and a copy of the plan is given to the chief executive under the new provision—

(a)the provision of the repealed regulation mentioned opposite the new provision in column 2 of the table continues to apply to the Authority as if the repealed regulation had not been repealed; and

(b)new schedule 2, section 2 does not apply to the Authority.

(4)In this section—

transitional period means the period—

(a)starting on the commencement; and

(b)ending on 30 November 2026 at the end of the day.

10Conditions on use of Brisbane Stadium (Lang Park)—stage and seating plan

(1)This section applies if—

(a)before the commencement, a stage and seating plan was prepared and given to the chief executive under the repealed regulation, schedule 2, section 5; and

(b)immediately before the commencement, the stage and seating plan was still in effect.

(2)From the commencement, the stage and seating plan is taken to be a stage and seating plan—

(a)prepared under new schedule 2, section 8(2); and

(b)given to the chief executive under new schedule 2, section 8(3).

1References to major sports facility and special events

In this schedule—

(a)a reference to the major sports facility is a reference to the major sports facility called Brisbane Stadium (Lang Park); and

(b)a reference to a special event is a reference to a special event prescribed under section 5 of this regulation for the major sports facility.

2Authority to ensure plans for special events are prepared and given to chief executive

(1)The Authority must ensure the operator has prepared the following plans for the use of the major sports facility for special events—

(a)a transport management plan, as amended from time to time under section 5;

(b)an operational management plan, as amended from time to time under section 5.

(2)The Authority must ensure the operator—

(a)has given the chief executive a copy of each plan mentioned in subsection (1); and

(b)if a plan is amended under section 5—has complied with section 5(4) in relation to the amendment.

3Transport management plan

(1)The operator must prepare a plan (a transport management plan) to provide for transport matters in relation to the use of the major sports facility for special events.

(2)In preparing the plan, the operator must consult with—

(a)the Stadium Management Advisory Committee; and

(b)the chief executive.

(3)The transport management plan must include the following—

(a)a car parking scheme to prevent intrusion by event-generated car parking in the area around the major sports facility;

(b)a communications strategy for informing the public about traffic and parking arrangements;

(c)details of road and street closures;

(d)details of train, bus and coach services;

(e)details of coach, taxi, limousine and private vehicle parking and set-down areas;

(f)pedestrian and traffic controls;

(g)details about access to the major sports facility and the area around the facility for emergency services;

(h)details about access to the major sports facility for trucks and semi-trailers, and parking, loading and unloading of those vehicles;

(i)parking arrangements for the set-up of special events;

(j)promotion of public transport, including, if relevant, a combined ticketing system for public transport and event entry;

(k)details about access to the major sports facility for persons with disability.

(4)The operator must give the chief executive a copy of the transport management plan.

4Operational management plan

(1)The operator must prepare a plan (an operational management plan) for the use of the major sports facility for special events.

(2)In preparing the plan, the operator must consult with—

(a)the Stadium Management Advisory Committee; and

(b)the chief executive.

(3)The operational management plan must—

(a)identify potential adverse effects of the use of the major sports facility for special events, including potential adverse effects of the following—

(i)any rehearsals, sound and light testing, or other ancillary activities necessary for, or incidental to, special events;

(ii)building work, including construction of a stage or a structure for equipment associated with special events;

Examples of equipment—

lighting or sound equipment

(iii)entertainment activities associated with special events; and

Examples of entertainment activities—

use of fireworks, helicopters or blimps

(b)state the strategies the operator is to implement to minimise the potential adverse effects identified under paragraph (a); and

(c)state the following matters—

(i)how the operator is to control noise relating to the use of the major sports facility for special events, including strategies the operator is to implement to reduce potential adverse effects of the noise on residents in the area around the major sports facility;

Examples of noise for subparagraph (i)—

noise from crowds, public address systems, speakers, amplifiers, building works or vehicles

(ii)how the operator is to monitor noise at the locations stated in section 11(1) and report on the noise under section 12;

(iii)details about where police officers are to be located at the major sports facility and in surrounding areas;

(iv)details of emergency and evacuation procedures;

(v)details of systems or procedures the operator is to implement to respond to, and resolve, complaints from members of the public; and

(d)state the strategies the operator is to implement to—

(i)manage and control crowd behaviour before, during and after special events; and

Examples of strategies to manage crowd behaviour—

policies stating conditions of entry or a code of behaviour, a strategy for the sale and use of alcohol, the use of closed-circuit television surveillance

(ii)without limiting subparagraph (i), manage and control crowd behaviour after special events to ensure the behaviour does not adversely affect the amenity of surrounding residential areas or cause a public nuisance; and

(iii)manage and control pedestrian and vehicular movements before and after special events; and

(iv)manage and control pedestrian use of pedestrian walkways, rather than surrounding residential areas, and public transport; and

(e)state the strategies the operator is to implement to minimise potential adverse effects on the use of Christ Church Milton and the operation of the pipeline known as Castlemaine Drain.

(4)The operator must give the chief executive a copy of the operational management plan.

(5)In this section—

Christ Church Milton—

(a)means the premises called Christ Church Milton at 3 Chippendall Street, Milton; and

(b)includes the associated rectory and gardens on the premises.

5Review and amendment of plans

(1)This section applies in relation to the following plans—

(a)a transport management plan;

(b)an operational management plan.

(2)The operator—

(a)must review each plan at least every 2 years after the plan is prepared; and

(b)may amend a plan at any time.

(3)However, before amending a plan to make a significant change, the operator must consult on the proposed amendment with—

(a)the Stadium Management Advisory Committee; and

(b)the chief executive.

(4)If a plan is amended under this section, the operator must give the chief executive a copy of the amendment or a copy of the plan as amended.

6Information for regulation of traffic under local laws

The operator must give the Brisbane City Council the information about the use of the major sports facility for special events that is necessary for the council to regulate the traffic area around the facility in accordance with its local laws.

7Lighting

The operator must ensure the technical parameters, design, installation, operation and maintenance of field, event and outdoor lighting for a special event comply with AS 4282-1997 (Control of the obtrusive effects of outdoor lighting).

8Building works and stage and seating plan

(1)The operator must ensure all building work for special events complies with the Building Act 1975.

(2)The operator must prepare a plan (a stage and seating plan) that—

(a)sets out stage and seating layouts for the use of the major sports facility for special events; and

(b)provides for access and evacuation in an emergency.

(3)The operator must—

(a)give the chief executive a copy of the stage and seating plan; and

(b)ensure the stage and seating plan is complied with at all times during a special event.

9Operating hours

(1)The operator must ensure—

(a)the part of a special event consisting of a rehearsal or sound test is carried out only between 10a.m. and 8p.m.; and

(b)if noise from a rehearsal or sound test is audible beyond the major sports facility—

(i)the noise is kept to the lowest level possible; and

(ii)the noise is not audible beyond the facility for more than 3 hours in total on any day.

(2)For the part of a special event other than a rehearsal or sound test, the operator must ensure—

(a)the part of the special event is held only between 10a.m. and 10.30p.m.; and

(b)the major sports facility is closed to the public by 11.30p.m.

10Operator must give public notice of special events

(1)The operator must, at least 20 business days before the start of a special event, give public notice of the special event by notice published on the website maintained by the operator for the major sports facility.

Note—

The website for the major sports facility is www.suncorpstadium.com.au.

(2)The notice must state—

(a)the nature of the special event; and

(b)the period during which the major sports facility will be used for the special event; and

(c)a phone number for making complaints to the operator about the special event; and

(d)the transport and parking arrangements for the special event.

11Noise

(1)During a special event, the operator must ensure noise levels from the event are continuously monitored by a suitably qualified acoustical consultant at, or as near as practicable to, the following locations—

(a)6/8 Petrie Terrace, Petrie Terrace;

(b)15 Plunkett Street, Paddington;

(c)36 Judge Street, Petrie Terrace;

(d)26 Princess Street, Petrie Terrace;

(e)31 Isaac Street, Milton.

(2)The operator must ensure the noise level from the special event is equal to or less than at least 1 (but not necessarily both) of the following levels—

(a)100dB(A) L_eq, measured at 15-minute periods, measured at a point 50m directly in front of the front edge of the performance stage;

(b)70dB(A) L_eq, measured at 15-minute periods, measured at the locations mentioned in subsection (1).

(3)The operator must ensure the taking of the noise measurements complies with the noise measurement manual.

(4)During the special event, the Authority must ensure that 1 of its employees or its agent—

(a)is present at the sound mixing desk for the event and is able to exercise ultimate control on the noise levels from the sound amplification equipment; and

(b)can contact and communicate with all of the acoustical consultants conducting the monitoring of the noise levels from the event.

(5)In this section—

AS 1055:2018 means AS 1055:2018 (Acoustics - Description and measurement of environmental noise).

department of the environment means the department in which the Environmental Protection Act 1994 is administered.

L_eq, for a particular period, means the time average A-weighted sound pressure level, within the meaning given by AS 1055:2018, for the period.

noise measurement manual means the document called ‘Noise measurement manual’, published by the department of the environment.

Note—

The document is available on the website of the department of the environment.

12Report

(1)The operator must, within 20 business days after the day a special event ends, give the chief executive a report that includes the following information—

(a)details the chief executive reasonably requires about the event;

(b)a summary of the number and type of any complaints received by the operator about the event;

(c)a brief description of the location the subject of each complaint received;

(d)details of any action taken by the Authority in relation to complaints received;

(e)details of any remedial action proposed for future special events.

(2)The operator must also, within 20 business days after the day a special event ends, give the chief executive a report by an accredited acoustical consultant that contains the following information—

(a)the starting and finishing time of each part of the event;

(b)details of noise measurements taken for the event;

(c)the times and locations, shown on a plan, at which the noise measurements were taken;

(d)details of the equipment and methods used to take the noise measurements;

(e)other information relevant to the consideration of the effect of the noise from the event on residents in the area around the major sports facility.
