This regulation may be cited as the Transport and Other Legislation Amendment Regulation (No. 2) 2026.

2Commencement

This regulation commences on 1 August 2026.

This part amends the Police Powers and Responsibilities Regulation 2026.

(1)This section applies to the following provisions of the Heavy Vehicle National Law (Queensland), as in force immediately before the commencement of the Heavy Vehicle National Law Amendment Act 2025
(a)section 254(1);
(b)section 256(1);
(c)section 258(1).
(2)Schedule 5, sections 5 and 16, as in force immediately before the commencement, continue to apply in relation to an offence—
(a)against a provision to which this section applies; and
(b)committed in relation to an existing heavy vehicle accreditation within the meaning of section 761 of the Heavy Vehicle National Law (Queensland) and to which that section applies.

23Insertion of new s 70A

After section 70
insert—

70AMeaning of relevant maintenance management system

(1)A relevant maintenance management system, for the operator of a heavy vehicle, means—
(a)a maintenance management system that continues in effect for a maintenance management accreditation under the Heavy Vehicle National Law (Queensland), section 761; or
(b)a safety management system that—
(i)includes policies, systems and procedures relating to the maintenance of the vehicle; and
(ii)complies with the safety management system standard for the purposes of heavy vehicle accreditation.
(2)In this section—
former, in relation to a provision of the Heavy Vehicle National Law (Queensland), means the provision as in force immediately before the commencement of the Heavy Vehicle National Law Amendment Act 2025, section 9.

heavy vehicle accreditation see the Heavy Vehicle National Law (Queensland), section 5.
maintenance management accreditation means a maintenance management accreditation under former section 5 of the Heavy Vehicle National Law (Queensland).
maintenance management system means a maintenance management system under former section 457 of the Heavy Vehicle National Law (Queensland) or a corresponding law.
safety management system see the Heavy Vehicle National Law (Queensland), section 457A.
safety management system standard means the safety management system standard approved under the Heavy Vehicle National Law (Queensland), section 654(1)(b).

24Amendment of s 71 (Requirement for certificate of inspection)

Section 71(2)(e)—

(e)a heavy vehicle maintained in accordance with a relevant maintenance management system for the operator of the vehicle; or

25Amendment of s 75 (Requirement for inspection certificate for disposal by owner)
