1Short title

This regulation may be cited as the Water Amendment Regulation 2026.

2Regulation amended

This regulation amends the Water Regulation 2016.

3Amendment of s 97 (Requirements for decommissioning a water bore—Act, s 817)

Section 97, after ‘published’—
insert—
, or otherwise made available free of charge,

4Amendment of s 104 (Duly qualified persons—Act, s 217B)

(1)Section 104(2)(c)—
omit, insert—
(c)for a function relating to a telemetry device—
(i)a person who holds certification as a telemetry installer and validator issued by Irrigation Australia; or

(ii)a person who is employed or subcontracted to install telemetry devices by a recognised telemetry installer.

(2)Section 104(5)—
insert—
recognised telemetry installer means—
(a)Aquamonix Pty Limited ACN 609 047 878; or

(b)Discovery Ag Pty Ltd ACN 117 305 567, trading as Goanna Ag; or

(c)SunWater; or

(d)an entity subcontracted to install telemetry devices by an entity mentioned in paragraph (a), (b) or (c).

5Amendment of s 127 (Conditions of water bore driller’s licence—Act, s 983A)
