1Short title

This regulation may be cited as the Fisheries Legislation Amendment Regulation 2026.

2Commencement

Part 3 commences on 1 July 2026.

3Regulation amended

This part amends the Fisheries (Commercial Fisheries) Regulation 2019.

4Insertion of new sch 2, s 103A

Schedule 2, after section 103
insert—

103A Tom’s fisheye

(1)An opening, commonly known as a Tom’s fisheye, in a net is a recognised BRD if the opening complies with this section.
(2)The opening must be—
(a)held open by a rigid frame that consists of—
(i)a hexagon-shaped external frame; and
(ii)a V-shaped external frame; and
(iii)a cone-shaped insert; and
(b)no more than 70 meshes from the cod end drawstrings of the net.
(3)The rigid frame must be installed so that the apex of the V-shaped external frame points towards the mouth of the net.
(4)The hexagon-shaped external frame must be—
(a)at least—
(i)360mm wide; and
(ii)200mm high; and
(b)attached—
(i)by a rigid bar from the top midpoint of the hexagon-shaped external frame to the top midpoint of the cone-shaped insert; and
(ii)by a rigid bar from the bottom midpoint of the hexagon-shaped external frame to the bottom midpoint of the cone-shaped insert.
(5)The widest point of the V-shaped external frame must be—
(a)equal to the width of the hexagon-shaped external frame; and
(b)attached, perpendicularly, to the widest part of the hexagon-shaped external frame.
(6)The cone-shaped insert must be—
(a)at least—
(i)340mm wide; and
(ii)185mm high; and
(iii)290mm long; and
(b)attached—
(i)by a rigid bar from a point on the left side of the cone-shaped insert, no more than 100mm from the open end of the insert, to the left arm of the V-shaped external frame with a gap of at least 20mm between the insert and the frame; and
(ii)by a rigid bar from a point on the right side of the cone-shaped insert, no more than 100mm from the open end of the insert, to the right arm of the V-shaped external frame with a gap of at least 20mm between the insert and the frame; and
(iii)by a rigid bar from the midpoint of the back of the cone-shaped insert to the apex of the V-shaped external frame with a gap of at least 29mm between the insert and the frame.
(7)There must be a gap of at least 94mm between the top side of the hexagon-shaped frame and the top side of the cone-shaped insert.
(8)During trawling, nothing must cover any part of the opening.

5Regulation amended

This part amends the Fisheries (General) Regulation 2019.

6Amendment of sch 3 (Declared fish habitat areas)

Schedule 3, entry for Bowling Green Bay FHA–007—
omit, insert—

Bowling Green Bay FHA–007 (revision 1)

The declared fish habitat area excludes the following—

•  land within the following lots that is not tidal land—
•  lot 2 on plan USL38596 (Bray Islet)
•  lot 3 on plan USL38596 (Bare Islet)
•  lot 4 on plan USL38596 (Bald Islet)
•  the area bounded by a 75m radius circle with the centre point at latitude 19°16.26714' south, longitude 147°03.77034' east.
