1Short title

This regulation may be cited as the Fisheries Legislation (Spanish Mackerel) Amendment Regulation 2026.

2Commencement

This regulation commences on 1 February 2026.

3Regulation amended

This part amends the Fisheries (Commercial Fisheries) Regulation 2019.

4Amendment of s 86 (Entitlement under SM unit)

181Application of increased total quota entitlement for 2025–2026 SM year

(1) This section applies to each SM unit held by the holder of an SM licence on 1 February 2026.
(2) The holder’s entitlement under the SM unit for the SM year starting on 1 July 2025 must be worked out under section 86 using the increased total quota entitlement for spanish mackerel.

Example—

The total number of SM units that have been issued is 577,984. The increased total quota entitlement for spanish mackerel for the SM year starting on 1 July 2025 is 250t.
Under subsection (2), the entitlement under each SM unit held by the holder of an SM licence on 1 February 2026 for the SM year is 0.43253792492kg, being 250t divided by 577,984.
If the holder holds 1,000 SM units on 1 February 2026, the holder’s total entitlement under the SM units is 432.53792492kg, being 1,000 times 0.43253792492kg.
(3)In this section—
increased total quota entitlement, for spanish mackerel, means the total quota entitlement for spanish mackerel for the SM year starting on 1 July 2025, as increased by the Fisheries Legislation (Spanish Mackerel) Amendment Regulation 2026.
total quota entitlement, for spanish mackerel, for an SM year, means the total quota entitlement stated for spanish mackerel in the quota declaration for the spanish mackerel commercial fishery for the SM year.

7Declaration amended

This part amends the Fisheries Quota Declaration 2019.

5Transitional provision for Fisheries Legislation (Spanish Mackerel) Amendment Regulation 2026

The total quota entitlement for the spanish mackerel commercial fishery for spanish mackerel, as increased by the Fisheries Legislation (Spanish Mackerel) Amendment Regulation 2026, applies for—
(a)the SM year starting on 1 July 2025; and
(b)a subsequent SM year.

Note—

See the Fisheries (Commercial Fisheries) Regulation 2019, section 181 for working out a holder’s entitlement under SM units for the SM year starting on 1 July 2025 using the increased total quota entitlement.
