This regulation may be cited as the Explosives Amendment Regulation 2025.
This regulation amends the Explosives Regulation 2017.
After section 7—
insert—7AParticular fireworks exempt from Act—Act, s 7
(1)A prohibited explosive is exempt from the Act if the prohibited explosive—(a)is a firework; and(b)is the subject of an authorisation under the Explosives Act 2003 (NSW), part 2A that expressly permits the transport of the prohibited explosive from New South Wales to Queensland; and(c)is being transported through Queensland from New South Wales to the Northern Territory.(2)The exemption is subject to the following conditions—(a)the transportation through Queensland must comply with the Australian dangerous goods code and the Australian explosives code;(b)without limiting paragraph (a), the prohibited explosives must be properly packaged and sealed during the period the prohibited explosives are in Queensland;(c) the route taken for the transportation through Queensland must be the shortest possible route, taking into account the need to minimise exposure of Queensland roads and Queensland road users to prohibited explosives;(d)no other cargo must be supplied to, or removed from, the vehicles transporting the prohibited explosives in Queensland.(3)The exemption is valid for the period that—(a)starts on the day the prohibited explosives enter Queensland; and(b)ends on the earlier of the following days—(i)the day the prohibited explosives leave Queensland;(ii)30 June 2025.(4)This section expires on 1 July 2025.
