1Short title

This regulation may be cited as the Medicines and Poisons (Medicines) Amendment Regulation (No. 4) 2023.

2Commencement

(1)Part 2 commences on 1 December 2023.
(2)Part 3 commences on 1 February 2024.

Part 3 Amendments commencing on 1 February 2024

14Amendment of s 117 (Amending written prescription)

(1)Section 117(4), after ‘amending the prescription’—

(5)Also, subsection (6) applies if the dispenser—
(a)is a participating pharmacist practising at a participating pharmacy who is dispensing under the extended practice authority called ‘Pharmacists—community pharmacy scope of practice pilot’; and
(b)is dispensing a medicine of an equivalent therapeutic effect to the medicine stated on the prescription (the original medicine) that—
(i)is a substitute for the original medicine; or
(ii)has a different form, strength or amount from the original medicine; or
(iii)has different instructions for use from the original medicine.
(6)The dispenser may amend the prescription to dispense a medicine mentioned in subsection (5)(b) without obtaining the agreement to the amendment from the prescriber who made the prescription.
(7)The dispenser must make an amendment under subsection (3) or (6) as follows—
(a)for subsection (3)—in the way agreed by the prescriber;
(b)for subsection (6)—by recording the following details on the prescription—
(i)the name of the dispenser;
(ii)the place where the dispenser usually practices;
(iii)the dispenser’s phone number;
(iv)the dispenser’s qualifications;
(v)the details of the relevant change made to the original medicine mentioned in subsection (5)(b);
(c)by signing and dating the amendment;
(d)in a way that does not obscure the information originally stated on the prescription before the amendment.

15Amendment of s 124 (Dispensing record for dispensed medicine)

Section 124(1)(m)—

16Amendment of s 159 (Amounts when selling S4 medicine)

4ADefinitions for division

In this division—
community pharmacy scope of practice pilot means the program set up by the department known as the ‘community pharmacy scope of practice pilot’.
participating pharmacist means a pharmacist approved by the chief executive to participate in the community pharmacy scope of practice pilot.
participating pharmacy means a community pharmacy approved by the chief executive as a place to which the community pharmacy scope of practice pilot applies.
