Major Events (Pacific Airshow Gold Coast) Regulation 2023

1Short title

This regulation may be cited as the Major Events (Pacific Airshow Gold Coast) Regulation 2023.

2Definitions

In this regulation—

crowd controller see the Security Providers Act 1993, section 5.

Pacific Airshow Gold Coast 2023 means the major event prescribed under section 3.

security officer see the Security Providers Act 1993, section 7.

3Pacific Airshow Gold Coast 2023 prescribed as major event—Act, s 12

For section 12(1) of the Act, the event known as the Pacific Airshow Gold Coast 2023 is prescribed as a major event.

4Major event organiser—Act, s 12

For section 12(2)(a) of the Act, Pacific Airshow Pty Ltd ACN 647 800 539 is prescribed as the major event organiser for the Pacific Airshow Gold Coast 2023.

5Major event areas—Act, s 12

For section 12(2)(b) of the Act, each of the areas stated in schedule 1, column 1 is prescribed as a major event area for the Pacific Airshow Gold Coast 2023.

6Major event period and control period—Act, s 12

(1)For section 12(2)(c) of the Act, the period starting on 18 August 2023 at 8a.m. and ending on 20 August 2023 at 5:30p.m. is prescribed as the major event period for the Pacific Airshow Gold Coast 2023.

(2)For section 12(3)(b) of the Act, the period starting on 18 August 2023 at 8a.m. and ending on 20 August 2023 at 5:30p.m. is prescribed as the control period for the Pacific Airshow Gold Coast 2023.

7Application of Act provisions to Pacific Airshow Gold Coast 2023—Act, s 12

For section 12(2)(d)(i) of the Act, the following provisions of the Act are prescribed as provisions that apply to the Pacific Airshow Gold Coast 2023 for the major event period—

(a)section 31, other than subsection (1)(a);

(b)section 36.

8Application of Act provisions to major event areas—Act, s 12

For section 12(2)(d)(ii) of the Act, the provisions of the Act stated in schedule 1, column 2 are prescribed as provisions that apply to the major event area stated opposite in schedule 1, column 1 for the period stated in schedule 1, column 3 for the major event area.

9Controlled area and application of Act provisions—Act, s 12

(1)For section 12(3)(a) of the Act, the area shown on the map in schedule 2, part 7 as the Surfers Paradise controlled area is prescribed as a controlled area for the Pacific Airshow Gold Coast 2023.

Note—

The areas shown on the maps in schedule 2, parts 2, 3, 4 and 6 as the Surfers Paradise controlled area are included for information purposes only.

(2)For section 12(3)(c) of the Act, sections 30 to 35 of the Act are prescribed as provisions that apply to the controlled area for the following periods—

(a)18 August 2023 from 8a.m. to 5:30p.m.;

(b)19 August 2023 from 8a.m. to 5:30p.m.;

(c)20 August 2023 from 8a.m. to 5:30p.m.

10Carrying out temporary works for Pacific Airshow Gold Coast 2023—Act, s 16

(1)This section applies in relation to the following major event areas for the Pacific Airshow Gold Coast 2023—

(a)the area shown as the Appel Park major event area on the map in schedule 2, part 1;

(b)the area shown as the Surfers Paradise major event area on the map in schedule 2, part 7.

(2)For section 16(2) of the Act, the following periods are prescribed—

(a)from 6 August 2023 at 8a.m. to 18 August 2023 at 8a.m.;

(b)from 20 August 2023 at 5:30p.m. to 26 August 2023 at 5:30p.m.

11Official logo—Act, s 51

For section 51(1)(a) of the Act, the logo shown in schedule 3, and a black and white copy of the logo, is declared to be an official logo for the Pacific Airshow Gold Coast 2023.

12Official titles—Act, s 51

For section 51(1)(b) of the Act, the title ‘Pacific Airshow Gold Coast’ is declared to be an official title for the Pacific Airshow Gold Coast 2023.

13Authorised persons—Act, s 56

For section 56(1)(d) of the Act, the other persons prescribed for the Pacific Airshow Gold Coast 2023 are—

(a)a crowd controller; and

(b)a security officer.

14Limitation on powers of particular authorised persons—Act, s 57

(1)For section 57(2) of the Act, this section limits the powers of particular authorised persons for the Pacific Airshow Gold Coast 2023.

(2)An authorised person may exercise a power under section 18(5) or 25 of the Act only if the person is—

(a)a police officer; or

(b)a crowd controller; or

(c)a security officer.

(3)Also, an authorised person may exercise a power under any of the following sections of the Act only if the person is a police officer—

(a)section 30(4);

(b)section 32(5);

(c)section 33(4);

(d)section 54(2);

(e)section 63;

(f)section 65(2).

15Expiry

This regulation expires on 27 August 2023.
