Justice Legislation (Fee Unit Conversion and Other Matters) Amendment Regulation 2022

Queensland Crest

Part 1 Preliminary

1Short title

This regulation may be cited as the Justice Legislation (Fee Unit Conversion and Other Matters) Amendment Regulation 2022.

2Commencement

This regulation commences on 1 July 2022.

3Regulation amended

This part amends the Agents Financial Administration Regulation 2014.

4Amendment of s 24 (Fee to inspect or copy details in register of undertakings—Act, s 135(3))

(1)Section 24, ‘$17.55’—
omit, insert—

17.55 fee units

(2)Section 24
insert—
(2)Subsection (3) applies for working out the amount of the fee prescribed by subsection (1).
(3)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 5 cents (rounding one-half upwards).

Example—

Subsection (1) prescribes a fee of 17.55 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 17.55 would be $26.325. Because $26.325 is halfway between $26.30 and $26.35, it is rounded upwards, so the amount of the fee for subsection (1) would be $26.35.

5Regulation amended

This part amends the Appeal Costs Fund Regulation 2010.

6Insertion of new s 2

After section 1
insert—

2Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.
(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or
(b)if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards).

Example for paragraph (a)—

If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

7Amendment of sch 1 (Additional fees on documents)

Schedule 1, column 2, heading, ‘$’—
omit, insert—

Fee units

8Amendment of sch 2 (Fees payable to board members)

Fee units

9Regulation amended

Schedule 6, column 3, heading, ‘$’—
omit, insert—

12Regulation amended

This part amends the Births, Deaths and Marriages Registration Regulation 2015.

After section 26
insert—

26ARounding of amounts expressed as numbers of fee units

Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

omit, insert—

0.65 fee units

(4)Section 222(2), from ‘$67.70’ to ‘$17.50’—
omit, insert—

67.70 fee units, plus a priority fee of 25.45 fee units if the certificate is required within 24 hours, plus a fee of 17.50 fee units

(5)Section 222
insert—
(4)Subsection (5) applies for working out the amount of a fee under this section.
(5)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 5 cents (rounding one-half upwards).

Example—

Subsection (1)(a)(i) prescribes a fee of 18.25 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 18.25 would be $27.375. Because $27.375 is halfway between $27.35 and $27.40, it is rounded upwards, so the amount of the fee for subsection (1)(a)(i) would be $27.40.

17Regulation amended

This part amends the Body Corporate and Community Management (Commercial Module) Regulation 2020.

18Amendment of s 179 (Fee for information given to interested persons—Act, s 205 [SM, s 233])

19Regulation amended

This part amends the Body Corporate and Community Management Regulation 2008.

20Insertion of new s 3A

8Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.

Example for paragraph (a)—

Section 5 prescribes a fee of 40.25 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 40.25 would be $60.375. Because $60.375 is halfway between $60.35 and $60.40, it is rounded upwards, so the amount of the fee for section 5 would be $60.40.

(c)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards).

5Fee for copy of investigation document

(1)The fees for copies of an investigation document are as follows—
(a)first copy—
(i)each page—2.95 fee units; and
(ii)maximum fee—76.75 fee units;
(b)additional copy—
(i)each page—0.65 fee units; and
(ii)maximum fee—30.60 fee units.
(2)Subsection (3) applies for working out the amount of a fee under this section.
(3)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 5 cents (rounding one-half upwards).

Example—

Subsection (1)(a)(i) prescribes a fee of 2.95 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 2.95 would be $4.425. Because $4.425 is halfway between $4.40 and $4.45, it is rounded upwards, so the amount of the fee for subsection (1)(a)(i) would be $4.45.

4Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.
(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 10 cents (rounding one-half upwards).

Example—

Schedule 1, item 2(a) prescribes a fee of 156.20 fee units. If the value of a fee unit for this regulation were $1.25, the number of dollars obtained by multiplying $1.25 by 156.20 would be $195.25. Because $195.25 is halfway between $195.20 and $195.30, it is rounded upwards, so the amount of the fee for schedule 1, item 2(a) would be $195.30.

67Replacement of pt 6 (Fees)

Part 6

Part 6 Supplying information on electoral rolls to local governments

14Price for supplying information on electoral rolls to local government—Act, s 61

(1)For section 61(1) of the Act, the price for supplying information about the electoral rolls mentioned in items 7 and 8 of the table in that subsection to a local government, on the local government’s request, is the sum of—
(a)507.30 fee units; and
(b)37.75 fee units for each 1,000 (or part of 1,000) electors enrolled for the local government area on 31 August immediately before the request for the information.
(2)The price under subsection (1) applies for the information mentioned in item 8 of the table in section 61(1) of the Act for a calendar year.

Note—

The information mentioned in item 8 of the table in section 61(1) of the Act is the changes to the most recent version of the electoral roll for a particular electoral district or districts. The price under subsection (1) applies for the changes to the electoral roll that happen in a calendar year.
(3)Subsection (4) applies for working out the amount of a price for supplying information about the electoral rolls under this section.
(4)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or
(b)if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards); or
(c)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards).

Example for paragraph (a)—

Subsection (1)(b) prescribes a price of 37.75 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 37.75 would be $56.625. Because $56.625 is halfway between $56.60 and $56.65, it is rounded upwards, so the price for subsection (1)(b) would be $56.65.

(i)first copy—2.95 fee units for each page, to a maximum fee of 76.75 fee units;

(3)Section 6
insert—
(3A)Subsection (5) applies for working out the amount of a fee under subsection (2) or (3).
(3B)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 5 cents (rounding one-half upwards).

Example—

Subsection (3)(a)(i) prescribes a fee of 2.95 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 2.95 would be $4.425. Because $4.425 is halfway between $4.40 and $4.45, it is rounded upwards, so the amount of the fee for subsection (3)(a)(i) would be $4.45.
(4)Section 6(3A) to (4)—

47A Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.
(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—

Example—

Subsection (1)(b) prescribes a fee of 0.25 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 0.25 would be $0.375. Because $0.375 is halfway between $0.35 and $0.40, it is rounded upwards, so the amount of the fee for subsection (1)(b) would be $0.40.

82Regulation amended

This part amends the Introduction Agents Regulation 2018.

83Insertion of new s 7A

After section 7
insert—

7A Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.
(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or
(b)if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards); or
(c)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards).

Example for paragraph (a)—

If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

Part 30 Amendment of Jury Regulation 2017

85Regulation amended

86Amendment of s 12 (Jury fees in civil cases—Act, s 65)

(1)Section 12(1), ‘$873.10’—
omit, insert—

873.10 fee units

(2)Section 12
insert—
(5)Subsection (6) applies for working out the amount of a fee under subsection (1).
(6)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards); or
(b)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards).

Example for paragraph (a)—

Subsection (1) prescribes a fee of 873.10 fee units. If the value of a fee unit for this regulation were $1.50, the number of dollars obtained by multiplying $1.50 by 873.10 would be $1,309.65. Because $1,309.65 is halfway between $1,309.60 and $1,309.70, it is rounded upwards, so the amount of the fee for subsection (1) would be $1,309.70.

(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or
(b)if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards); or
(c)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards); or
(d)if the result is more than $5,000 but not more than $100,000—to the nearest multiple of 10 dollars (rounding one-half upwards).

19AA Rounding of amounts expressed as numbers of fee units

(1)This section applies for working out the amount of a fee expressed in this regulation as a number of fee units.
(2)For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded—
(a)if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or
(b)if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards); or
(c)if the result is more than $1,000 but not more than $5,000—to the nearest dollar (rounding one-half upwards); or
(d)if the result is more than $5,000 but not more than $100,000—to the nearest multiple of 10 dollars (rounding one-half upwards).

Example—

If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

4ARounding of amounts expressed as numbers of fee units

Example—

If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

177Insertion of new s 17AA

Before section 17A
insert—

17AA Rounding of amounts expressed as numbers of fee units

18AA Rounding of amounts expressed as numbers of fee units
