This regulation may be cited as the Transport Legislation (Fee Unit Conversion and Registration Fees) Amendment Regulation 2022.

Part 14, division 3 commences on 1 July 2022.

(1)This section applies for working out the amount of an annual levy expressed in this part as a number of fee units.
(2)For the purposes of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded to the nearest multiple of 5 cents (rounding one-half upwards).

Example—

If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

5Amendment of s 2 (Marina owner levy—Act, s 42)

25Amendment of s 200 (Fees and charges)

(1A)A fee payable under schedule 6, part 1, division 1 for the registration, or renewal of registration, of a Queensland regulated ship for a term is the fee in force on 1 July in the financial year in which the term starts.
(1B)A fee payable under schedule 6, part 1, division 4, item 13(b) for the occupation component of a buoy mooring approval is the fee in force on 1 July in the financial year in which the offer to occupy the buoy mooring is accepted by the person who applied for the approval.
(1C)A fee payable under schedule 6, part 1, division 4, item 14 for the renewal of a buoy mooring approval is the fee in force on 1 July in the financial year in which the renewed term starts.

206Application of division

This division applies to ships to which part 8 of the Act applies.

206A Fees for navigating ship in pilotage area using pilot

(1)Schedule 6, part 2, division 1 states the fees payable for a person navigating a ship in a pilotage area using the services of a pilot.
(2)For schedule 6, part 2, division 1, a relevant movement for a ship is—
(a)a ship’s arrival at, or departure from, a pilotage area; or
(b)a ship’s removal to another berth or anchorage in a pilotage area.
(3)Subsection (4) applies if the port shipping manual for a pilotage area states, or the general manager reasonably believes for a pilotage area, that for safety reasons the services of more than 1 pilot (other than an excluded pilot) are to be used for an arrival, departure or removal of a ship in the pilotage area.
(4)The fee stated in schedule 6, part 2, division 1 is payable for each pilot other than an excluded pilot.
(5)Also, if a ship departs from a pilotage area and a pilot can not leave the ship after pilotage of the ships ends, an additional fee for the amount of the reasonable costs of returning the pilot to the pilotage area is payable, unless the pilot is not able to leave the ship because of something beyond the control of the ship’s master.
(6)In this section—
excluded pilot means a person who is—
(a)a supervising pilot; or
(b)being trained as a pilot, or having their competence as a pilot assessed, by a supervising pilot.
port shipping manual, for a pilotage area, means the document called ‘Port procedures and information for shipping’ for the pilotage area.

206B Fees for cancelling pilotage services

(1)Schedule 6, part 2, division 2 states the fees payable if the owner or master of a ship cancels a pilotage service for the ship arranged with a harbour master for a pilotage area without giving the harbour master appropriate notice of the cancellation.
(2)In this section—
appropriate notice means notice of at least—
(a)if the general manager considers a period of less than 3 hours is necessary for the effective and efficient operation of the pilotage service in a pilotage area—the period stated by the general manager by gazette notice for the pilotage area; or
(b) otherwise—3 hours.

206C Fees for delaying pilotage services

(1)Schedule 6, part 2, division 3 states the fees payable if—
(a)the owner or master of a ship—
(i)has arranged a pilotage service for the ship with a harbour master; and
(ii)has not given the harbour master appropriate notice of a cancellation of the pilotage service under section 206B; and
(b)the pilotage service for the ship is delayed for longer than 30 minutes, but not longer than 2 hours, after the time arranged for the service with the harbour master.
(2)The fee payable is—
(a)if the pilotage service for the ship is delayed for longer than 30 minutes but not longer than 1 hour—the fee stated in schedule 6, part 2, division 3; or
(b)if the pilotage service for the ship is delayed for longer than 1 hour but not longer than the cancellation period—the fee stated in schedule 6, part 2, division 3 for each hour, or part of an hour, the service is delayed.
(3)If the pilotage service for the ship is delayed for longer than the cancellation period—
(a)the pilotage service is taken to have been cancelled; and
(b)the fee for cancelling the pilotage service under schedule 6, part 2, division 2 is payable as if the service had been cancelled without appropriate notice under section 206B.
(4)In this section—
cancellation period means a delay of longer than—
(a)if the general manager considers a period of longer than 2 hours is necessary for the effective and efficient operation of the pilotage service in a pilotage area—the period stated by the general manager by gazette notice for the pilotage area; or
(b)otherwise—2 hours.
delay does not include delay caused by weather affecting a ship’s ability to be safely navigated.

208A When conservancy dues are payable

(1)A conservancy due stated in schedule 6, part 3 is payable for a ship on the day the ship completes its first arrival at, removal within or departure from, a compulsory pilotage area.
(2)The conservancy due covers all the ship’s arrivals at, removals within or departures from, any compulsory pilotage area for 30 days from the day mentioned in subsection (1).
(3)After the 30 days mentioned in subsection (2), subsections (1) and (2) apply again.
