This regulation may be cited as the Transport Legislation Amendment Regulation (No. 3) 2021.

2Commencement

Sections 11 and 13 commence on 1 March 2022.

3Regulation amended

This part amends the Transport Infrastructure (Public Marine Facilities) Regulation 2011.

237Definitions for part

In this part—
former standard means the National Standard for the Australian Builders Plate for Recreational Boats endorsed by the former Australian Transport Council and published on 23 May 2011 by the entity formerly known as the National Marine Safety Committee.
transitional period means the period starting on the commencement and ending at the end of 28 February 2022.

238Application of s 30 during transitional period

During the transitional period, section 30(1)(a)(i) applies in relation to a safety management system for a ship as if a reference in the section to complying with the requirements mentioned in Marine Order 504 (Certificates of operation and operation requirements — national law) 2018 (Cwlth) were a reference to either of the following—
(a)complying with the requirements mentioned in Marine Order 504 (Certificates of operation and operation requirements — national law) 2018 (Cwlth);
(b)dealing with the matters mentioned in the NSCV, part E.

239Application of s 32 during transitional period

For section 32(2), during the transitional period a builders plate fixed to a ship in accordance with the former standard is taken to be fixed to the ship in accordance with the ABP Standard.

240Provision for particular offences during transitional period

(1)This section applies if—
(a)during the transitional period, a person does an act, or omits to do an act, that would, but for this section, constitute an offence against a provision of this regulation; and
(b)the act or omission would, but for this section, constitute an offence against the provision only because, for applying the provision, the ABP Standard as modified by section 42 applies rather than the former standard as modified by section 42 as in force immediately before the commencement.
(2)The act or omission does not constitute an offence against the provision.
