1Short title

This plan may be cited as the Water Plan (Burdekin Basin) (Applications for Water Licences) Amendment Plan 2020.

2Plan amended

This plan amends the Water Plan (Burdekin Basin) 2007.

3Declaration—Act, s 1259

Section 4 is made for section 1259(7) of the Act.

4Amendment of s 26A (Particular applications for water licences that must not be accepted)

Section 26A(1)—
omit, insert—
(1)This section does not apply to an application for a water licence if—
(a)section 26 applies to the application; or
(b)the application is for a licence to interfere with the flow of surface water to artificially change or improve the course of a watercourse, lake or spring; or
(c)the application—
(i)is made as part of the process mentioned in section 33A(2) for releasing unallocated water; and
(ii)is for a licence to take—
(A)surface water held as a general reserve in subcatchment area E, F or G; or
(B)surface water held as a strategic reserve for a State purpose in subcatchment area E, F or G.

5Amendment of s 31 (Volume of unallocated water held as general reserve or strategic reserve for subcatchment areas)

section 30(a) or (b)

6Omission of s 81 (Definition for subdivision)

88Application of s 26A

Section 26A, as in force on the commencement, applies to an application for a water licence made before or after the commencement.

Note—

From the commencement, section 26A includes particular resource operation plan provisions of a kind mentioned in section 1264(c) of the Act. For how the provisions were taken to have effect for the purposes of this plan before the commencement, see sections 1259(2)(e) and (7) of the Act.

8Expiry

This plan expires on the day after it is notified.
