1Short title

This regulation may be cited as the Mining Safety and Health Legislation (Respirable Coal Dust and Silica) Amendment Regulation 2020.

2Commencement

This regulation commences on 1 September 2020.

3Regulation amended

This part amends the Coal Mining Safety and Health Regulation 2017.

4Amendment of s 89 (Dust)

Section 89(1)(b)(i) and (ii)—
omit, insert
(i)for coal dust—1.5mg/m3 air;
(ii)for free silica—0.05mg/m3 air.

Part 9 Transitional provision for Mining Safety and Health Legislation (Respirable Coal Dust and Silica) Amendment Regulation 2020

409Levels of dust under s 89(1) for dust monitoring and reporting procedure

(1)Section 89A applies as if each reference in the section to section 89(1) were a reference to section 89(1) as in force immediately before the commencement.
(2)This section stops applying on 1 January 2021.

6Regulation amended

This part amends the Mining and Quarrying Safety and Health Regulation 2017.

7Amendment of sch 5 (General exposure limits for hazards)

Schedule 5, entry for crystalline silica, column 2, ‘0.1mg/m3’—
omit, insert—
