Part 1 Preliminary

1Short title

This regulation may be cited as the Heavy Vehicle National Legislation Amendment Regulation 2020.

2Commencement

This regulation commences on 28 February 2020.

3Regulation amended

This part amends the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

4Insertion of new Sch 6, s 6A

Schedule 6, after section 6
insert—

6ALength—front blind spot mirror disregarded

For this Regulation, a front blind spot mirror, fitted to a heavy vehicle in accordance with section 13A of Schedule 2 to the Heavy Vehicle (Vehicle Standards) National Regulation, is to be disregarded for the purpose of measuring the length of the heavy vehicle unless the mirror projects more than 150mm beyond the body of the heavy vehicle.

5Amendment of Sch 6, s 8 (Height)

(1)Schedule 6, section 8, after the note—
insert—
(ba)for a specified semitrailer—4.6m; or
(2)Schedule 6, section 8, before ‘A’—

6Regulation amended

This part amends the Heavy Vehicle (Vehicle Standards) National Regulation.

7Amendment of Sch 2, s 4 (Steering)

Schedule 2, section 4(3)—
omit, insert—
(3)In relation to a heavy motor vehicle built before 1 January 2005, a component of the steering system of the vehicle that is essential for effective steering of the vehicle must be built to transmit energy by mechanical means only.

8Insertion of new Sch 2, s 13A

Schedule 2, after section 13—
insert—

13AFront blind spot mirrors

(1)A heavy motor vehicle may be fitted with a front blind spot mirror that complies with the requirements of ADR 14/02 in relation to a Class VI front mirror.
(2)A front blind spot mirror, fitted to a heavy motor vehicle in accordance with subsection (1), is to be disregarded for the purpose of requirements about the length of a motor vehicle in third edition ADR 43/04 unless the mirror projects more than 150mm beyond the body of the heavy vehicle.

Note—

The Heavy Vehicle (Mass, Dimension and Loading) National Regulation, Schedule 6, section 3 prescribes the maximum length of a heavy vehicle.
