1Short title

This regulation may be cited as the Racing (Transitional) Regulation 2016 .

2Commencement

This regulation commences on 1 July 2016.

3Declaration that regulation is a transitional regulation—Act, s 495

This regulation is a transitional regulation.

Note—

Under section 495(4) of the Act, this regulation expires on 1 July 2017.

4Application of rules of racing

(1)The rules of racing for each code of racing, as in force immediately before the commencement, continue to have effect as rules of racing for the code of racing and are taken to have been made under the amended Act.
(2)In applying the rules of racing for a code of racing, if a rule provides for an entity to perform a function that is a function of the commission, or take action in a matter relevant to the performance of a function of the commission, the commission and not the entity may perform the function or take the action, including—
(a)appointing stewards; and
(b)penalising participants.

Examples of other matters relevant to the performance of a function of the commission—

appointing starters and judges, regulating matters relating to breeding, issuing warning off notices, licensing bookmakers, prohibiting substances and licensing animals
(3)Without limiting subsection (2), in applying the rules of racing for a code of racing, a reference to the ‘Principal Racing Authority’, ‘control body’, ‘controlling body’ or ‘Racing Queensland’ in a rule about a matter relevant to the performance of a function of the commission is taken to be a reference to the commission.
(4)In this section— amended Act means the Act as amended by the Racing Integrity Act 2016 .
