2014.Note—Undersection11(9)oftheAct,thisnoticeremainsinforceuntilwhichever of the following first
happens—(a)the commencement of a regulation under
section 11(1) of the Act inrelation to the same matter;(b)the end of 3 months.2DefinitionsIn this
notice—cucumbergreenmottlemosaicmeanstheCucumbergreenmottle mosaic virus.infestedplantmeansaplantofthefamilyCucurbitaceaeinfested with
cucumber green mottle mosaic.pest quarantine
areameans the pest quarantine area
declaredunder section 3.restricted
itemmeans any of the following—(a)the cucumber green mottle
mosaic;(b)plants of the familyCucurbitaceae;(c)soilwhichhas,ormayhave,comeincontactwithinfested plants;(d)an
appliance used, or that may have been used, in theharvesting,plantingorproductionofplantsoftheCurrent as at 25 November 2014Page

example, secateursor other cutting implements;(e)packing materials used, or that may
have been used, forpacking plants of the familyCucurbitaceae.Examples of plants of the family
Cucurbitaceae—cucumber, melon, pumpkin,
squash3Declaration of pest quarantine
areaThe whole of Queensland is declared to be a
pest quarantinearea for cucumber green mottle
mosaic.4Objects of quarantineThe
objects of the quarantine are—(a)topreventtheintroductionofcucumbergreenmottlemosaic into the
pest quarantine area; and(b)to prevent the
spread of cucumber green mottle mosaicin the pest
quarantine area; and(c)to control or
remove cucumber green mottle mosaic inor from the pest
quarantine area.5Restriction on moving restricted item
into pestquarantine area(1)A
person must not, without an inspector’s approval, move arestricted item into the pest quarantine
area.(2)An inspector may give an approval
under subsection (1), withorwithoutconditions,onlyiftheinspectorissatisfiedthemovement of the restricted item will not
pose a significant riskof—(a)introducing cucumber green mottle mosaic
into the pestquarantine area; or(b)spreadingcucumbergreenmottlemosaicinthepestquarantine

moving restricted item within or out ofpest quarantine
area(1)A person must not, without an
inspector’s approval, move arestricted item
within or out of the pest quarantine area.(2)An
inspector may give an approval under subsection (1), withorwithoutconditions,onlyiftheinspectorissatisfiedmovement of the
restricted item will not pose a significant riskof—(a)introducing
cucumber green mottle mosaic into the pestquarantine area;
or(b)spreadingcucumbergreenmottlemosaicinthepestquarantine
area.7Obligation to keep documents relating
to movement ofplant of the familyCucurbitaceae(1)Thissectionappliesifapersonmoves,afterthecommencement, a plant of the familyCucurbitaceaethat wasgrown on a parcel of land in Queensland
to—(a)another parcel of land in Queensland;
or(b)outside Queensland.(2)The owner of the parcel of land from
which the plant is movedmust keep a copy of any relevant
movement document for themovement for at least 1 year after the
plant is moved from theland.(3)In
this section—relevant movement document,
for the movement of a plant ofthe
familyCucurbitaceae, means the
following—(a)a document that relates to the
movement;(b)if the movement is for a sale of the
plant—a documentthat relates to the sale.8Obligation of land owner to allow
surveillance(1)If an inspector requires an owner of
land in the pest quarantineareatoallowtheinspectortocarryoutsurveillanceontheCurrent as at 25 November 2014Page

2014[s 8]landtolookforandmonitorthespreadofcucumbergreenmottlemosaic,theownermustnotrefusetoallowtheinspector to carry out surveillance.(2)Without limiting subsection
(1),an inspector may carry outsurveillance on the land by testing a plant
or soil which mayhavecomeincontactwithinfestedplantsandtestingthesample, or having another person test the
sample, on the landor at another place.(3)The
inspector may direct the owner to move or remove anything on the land that would obstruct the
inspector carryingout surveillance on the land.Examples of things an inspector may direct
to be moved or removed—machinery,
rubbish, scrap metal, vegetation(4)When
making the requirement or direction, the inspector mustgive
the person an offence warning.(5)In
this section—landdoes not include
