Plant Protection (Cucumber Green Mottle Mosaic) Quarantine Notice 2014 [s 1] Plant Protection (Cucumber Green Mottle Mosaic) Quarantine Notice 2014 [reprinted as in force on 25 November 2014] 1 Short title This notice may be cited as the Plant Protection (Cucumber Green Mottle Mosaic) Quarantine Notice 2014 . Note Under section 11(9) of the Act, this notice remains in force until whichever of the following first happens— (a) the commencement of a regulation under section 11(1) of the Act in relation to the same matter; (b) the end of 3 months. 2 Definitions In this notice— cucumber green mottle mosaic means the Cucumber green mottle mosaic virus . infested plant means a plant of the family Cucurbitaceae infested with cucumber green mottle mosaic. pest quarantine area means the pest quarantine area declared under section 3. restricted item means any of the following— (a) the cucumber green mottle mosaic; (b) plants of the family Cucurbitaceae ; (c) soil which has, or may have, come in contact with infested plants; (d) an appliance used, or that may have been used, in the harvesting, planting or production of plants of the Current as at 25 November 2014 Page 3

Examples of plants of the family Cucurbitaceae cucumber, melon, pumpkin, squash 3 Declaration of pest quarantine area The whole of Queensland is declared to be a pest quarantine area for cucumber green mottle mosaic. 4 Objects of quarantine The objects of the quarantine are— (a) to prevent the introduction of cucumber green mottle mosaic into the pest quarantine area; and (b) to prevent the spread of cucumber green mottle mosaic in the pest quarantine area; and (c) to control or remove cucumber green mottle mosaic in or from the pest quarantine area. 5 Restriction on moving restricted item into pest quarantine area (1) A person must not, without an inspector’s approval, move a restricted item into the pest quarantine area. (2) An inspector may give an approval under subsection (1), with or without conditions, only if the inspector is satisfied the movement of the restricted item will not pose a significant risk of— (a) introducing cucumber green mottle mosaic into the pest quarantine area; or (b) spreading cucumber green mottle mosaic in the pest quarantine area. Plant Protection (Cucumber Green Mottle Mosaic) Quarantine Notice 2014 [s 6] 6 Restriction on moving restricted item within or out of pest quarantine area (1) A person must not, without an inspector’s approval, move a restricted item within or out of the pest quarantine area. (2) An inspector may give an approval under subsection (1), with or without conditions, only if the inspector is satisfied movement of the restricted item will not pose a significant risk of— (a) introducing cucumber green mottle mosaic into the pest quarantine area; or (b) spreading cucumber green mottle mosaic in the pest quarantine area. 7 Obligation to keep documents relating to movement of plant of the family Cucurbitaceae (1) This section applies if a person moves, after the commencement, a plant of the family Cucurbitaceae that was grown on a parcel of land in Queensland to— (a) another parcel of land in Queensland; or (b) outside Queensland. (2) The owner of the parcel of land from which the plant is moved must keep a copy of any relevant movement document for the movement for at least 1 year after the plant is moved from the land. (3) In this section— relevant movement document , for the movement of a plant of the family Cucurbitaceae , means the following— (a) a document that relates to the movement; (b) if the movement is for a sale of the plant—a document that relates to the sale. 8 Obligation of land owner to allow surveillance (1) If an inspector requires an owner of land in the pest quarantine area to allow the inspector to carry out surveillance on the Current as at 25 November 2014 Page 5
Plant Protection (Cucumber Green Mottle Mosaic) Quarantine Notice 2014 [s 8] land to look for and monitor the spread of cucumber green mottle mosaic, the owner must not refuse to allow the inspector to carry out surveillance. (2) Without limiting subsection (1), an inspector may carry out surveillance on the land by testing a plant or soil which may have come in contact with infested plants and testing the sample, or having another person test the sample, on the land or at another place. (3) The inspector may direct the owner to move or remove any thing on the land that would obstruct the inspector carrying out surveillance on the land. Examples of things an inspector may direct to be moved or removed machinery, rubbish, scrap metal, vegetation (4) When making the requirement or direction, the inspector must give the person an offence warning.
