commencement—(a)an application for review of a
relevant decision had beenmade but not decided or otherwise
finally dealt with; or(b)the period in
which a person was entitled to apply underthe unamended
Act for review of a relevant decision hadstarted but not
ended.(2)Thereviewoftherelevantdecisionmaybecompleted,orstarted and completed, as if—(a)the Act had not been amended by the
amending Act; and(b)theQBCCAct,part7,division3didnotapplyforreview of the decision.(3)In this section—relevant
decisionmeans a decision under part 4, division 3
oftheBuildingRegulation2006asinforcebeforethecommencementoftheBuildingandOtherLegislationAmendment

matters from chiefexecutive to QBCC6Pending legal proceedings(1)A legal proceeding in relation to a
relevant offence that hasbeenstarted,orcouldhavebeenstarted,byoragainstthechief executive before the
commencement may be started orcontinued by or
against the QBCC commissioner.(2)Forsection256(1)oftheAct,theQBCCcommissioneristakentohaveknowledgeofthecommissionofapastoffence—(a)if the offence came to the chief
executive’s knowledge;and(b)whentheoffencecametothechiefexecutive’sknowledge.(3)If a
prosecution for a relevant offence against the unamendedAct
is started by the chief executive under section 256(2) ofthat
Act before the commencement, the QBCC commissioneris
taken to be the complainant for continuing the prosecution.(4)In this section—legalproceedingmeansaproceedingbeforeacourtortribunal.past
offencemeans a relevant offence for which—(a)theallegeddateofcommissionoftheoffencewasbefore the commencement; and(b)the prosecution of the offence had not
yet started beforethe commencement.relevantoffencemeansanoffenceagainsttheunamendedAct, other than
an offence against a provision of chapter 7 or7A of the

7]7Chief executive to give QBCC
commissioner details ofrelevant certificates(1)Thissectionappliesif,within3monthsafterthecommencement,thechiefexecutivereceivesdetailsofabuildingcertificateundersection246APoftheunamendedAct.(2)The
chief executive must give the details of the certificate tothe
QBCC commissioner as soon as practicable.8Approvals of pool safety inspector tests by
chiefexecutive before commencement
continue(1)Subsection(2)appliestoanapprovalofapoolsafetyinspector test—(a)given by the chief executive under the
unamended Act;and(b)in effect
immediately before the commencement.(2)The
approval continues in effect as if the approval had beengiven by the QBCC Commissioner.9Other administrative matters relating
to chief executive(1)Subsection (2) applies to each of the
following things in effectundertheunamendedActimmediatelybeforethecommencement—(a)a
notice given by the chief executive in relation to poolsafety;Example—a notice about the approval of a pool
safety management plangiven under section 245O(4)(a) of the
unamended Act(b)a requirement or request in relation
to pool safety madeby the chief executive that has not been
fully compliedwith on the commencement;Page

made under section 245N of the unamendedAct,thatanownergivethechiefexecutivefurtherinformation about a pool safety management

of the unamendedAct,ofalocalgovernmenttogivethechiefexecutiveinformation about a regulated pool(c)adecisionofthechiefexecutiveinrelationtopoolsafety.(2)The thing continues in effect as if it
had been given or madeby the QBCC commissioner when the
thing first took effect.(3)If the chief
executive receives a notice or other informationfrom
a person in relation to a thing mentioned in subsection(1)
after the commencement, the chief executive must give thenoticeorotherinformationtotheQBCCcommissionerassoon
