purpose of this part is to provide for the transfer of
assetsand liabilities from the training department
to QTAMA andother related matters.6Definitions for pt 3In this
part—trainingdepartmentmeansthedepartmentinwhichtheTAFE
Queensland Act 2013is administered.transfer
daymeans 1 July 2014.transferringassetsandliabilitiesmeanstheassetsandliabilitiesshowninthetransferringassetsandliabilitiesschedule.transferringassetsandliabilitiesschedulemeansthescheduleheldbythechiefexecutiveofthetrainingdepartmentshowingparticularassetsandliabilitiesoftheState relating to the training
department immediately beforethe transfer
day.transferringinstrumentmeansaninstrumentshowninthetransferring
instruments schedule.transferring instruments
schedulemeans the schedule heldbythechiefexecutiveofthetrainingdepartmentshowingparticularinstrumentsapplyingtothetrainingdepartmentimmediately
before the transfer day.7Transfer of

provisions[s 8]8Accounting treatment for transferring assets
andliabilities(1)Foraccountingpurposes,thetrainingdepartmentandQTAMA must treat—(a)the
transfer of the transferring assets to QTAMA as—(i)an increase in QTAMA’s contributed
equity; and(ii)a decrease in
the training department’s contributedequity;
and(b)the assumption of the transferring
liabilities by QTAMAas—(i)a
redemption of QTAMA’s contributed equity; and(ii)an
increase in the training department’s contributedequity; and(c)thevalueofthetransferringassetstransferredtoQTAMA as being equivalent to the carrying
value of thetransferringassetsrecordedintheaccountsofthetraining department immediately before
the transfer day;and(d)thevalueofthetransferringliabilitiesassumedbyQTAMA as being equivalent to the
carrying value of thetransferringliabilitiesrecordedintheaccountsofthetraining
department immediately before the transfer day.(2)In
this section—transferring assetsmeans the assets
shown in the transferringassets and liabilities
schedule.transferringliabilitiesmeanstheliabilitiesshowninthetransferring
assets and liabilities schedule.9Successor in lawQTAMA is the
successor in law of the training department inrelation to the
following—(a)the transferring assets and

transferring instruments;(c)the legal
proceedings for which section 11 applies;(d)the
records mentioned in section 12.10Transferring instruments(1)A
transferring instrument applies to QTAMA in place of thetraining department.(2)Without limiting subsection (1)—(a)anyright,title,interestorliabilityofthetrainingdepartmentarisingunderorrelatingtoatransferringinstrument is
taken to be transferred from the trainingdepartment to
QTAMA; and(b)atransferringinstrument,includingabenefitorrightprovided by a
transferring instrument, given to, by or infavour of the
training department is taken to have beengiven to, by or
in favour of QTAMA; and(c)QTAMAistakentobeapartytoeachtransferringinstrument in
place of the training department; and(d)a
reference to the training department in a transferringinstrument is taken to be a reference to
QTAMA; and(e)anapplicationinrelationtoatransferringinstrumentmade in the name
of the training department is taken tohave been made
in QTAMA’s name; and(f)a transferring
instrument under which an amount is, ormay become,
payable to or by the training department istaken to be an
instrument under which the amount is, ormay become,
payable to or by QTAMA in the way theamount was, or
might have become, payable to or by thetraining
department; and(g)atransferringinstrumentunderwhichproperty,otherthan money, is
or may become liable to be transferred,conveyed or
assigned to or by the training department istakentobeaninstrumentunderwhichpropertyis,ormaybecomeliabletobe,transferred,conveyedorPage 6Current as at 1

by QTAMA in the way the property was,or might have
become, liable to be transferred, conveyedor assigned to
or by the training department.11Pending legal proceedings(1)Thissectionappliesforalegalproceedingthat,beforethetransferday,couldhavebeenstartedorcontinuedbyoragainst the State in relation to any
of the following—(a)a transferring instrument;(b)any of the transferring assets and
liabilities;(c)a record transferred to QTAMA under
section 12.(2)Thelegalproceedingmustbestartedorcontinuedbyoragainst QTAMA.12Transfer of recordsOnthetransferday,therecordsoftheStaterelatingtothetransferring
assets and liabilities and transferring instrumentsbecome the records of QTAMA.Current as at 1 July 2014Page
