Education (Accreditation of Non-State Schools) Transitional Regulation 2013 [s 1] Education (Accreditation of Non-State Schools) Transitional Regulation 2013 [reprinted as in force on 29 August 2013] 1 Short title This regulation may be cited as the Education (Accreditation of Non-State Schools) Transitional Regulation 2013 . 2 Commencement This regulation is taken to have commenced on 29 August 2013. 3 Declaration that regulation is a transitional regulation This regulation is a transitional regulation. Note Under section 252(4) of the Act, this regulation expires on 29 August 2015. 4 Decision for application for accreditation to provide a type of education—Act, s 18 (1) This section applies to an application for the accreditation of a school made before 1 January 2015 if— (a) the school is provisionally accredited, or accredited, to provide at least 1 type of education; and (b) the application is for accreditation to provide a further type of education; and (c) the student-intake day stated in the application is a day on or after 1 January 2015. (2) The board must consider and decide the application under section 18 of the Act as if— Current as at 29 August 2013 Page 3
Education (Accreditation of Non-State Schools) Transitional Regulation 2013 [s 5] (a) primary education does not include education offered in year 7; and (b) secondary education includes education offered in year 7. 5 Decision for application to change an attribute of provisional accreditation—Act, s 52 (1) This section applies to an application made under section 49 of the Act before 1 January 2015 if— (a) the application is to change an attribute of provisional accreditation applying to a school, other than a change in the school’s governing body; and (b) the change is to take effect on or after 1 January 2015. (2) The board must consider and decide the application under section 52 of the Act as if— (a) primary education does not include education offered in year 7; and (b) secondary education includes education offered in year 7.
