5]De-amalgamation polls5Questions for de-amalgamation pollsThe
question to be submitted to the voters in the affected partof
the local government area for a de-amalgamation poll is asfollows—(a)for
the Douglas area de-amalgamation poll—“Should aDouglasShireCouncilbecreatedbythede-amalgamation of the Cairns Regional
Council localgovernmentarea,withthecoststobemetbytheDouglas Shire Council?”;(b)fortheLivingstoneareade-amalgamationpoll—“ShouldaLivingstoneShireCouncilbecreatedbythede-amalgamationoftheRockhamptonRegionalCouncil local government area, with the
costs to be metby the Livingstone Shire Council?”;(c)fortheNoosaareade-amalgamationpoll—“ShouldaNoosa Shire Council be created by the
de-amalgamationoftheSunshineCoastRegionalCouncillocalgovernment area, with the costs to be met by
the NoosaShire Council?”;(d)for the Mareeba area de-amalgamation
poll—“Should aMareebaShireCouncilbecreatedbythede-amalgamationoftheTablelandsRegionalCouncillocal government
area, with the costs to be met by theMareeba Shire
Council?”.6Date of

de-amalgamation poll must be held on 9 March 2013.(2)However, the electoral commission may,
by gazette notice, fixa later day as the polling day for a
de-amalgamation poll if theday is likely to

De-amalgamation polls[s 7](3)Iftheelectoralcommissionerfixesalaterdayforade-amalgamationpollundersubsection(2),thereturningofficer for the
poll—(a)maygiveanynecessarydirectionstothevotersaboutthe
procedures to be followed; and(b)mustpublishanoticedetailingthedirectionsinanewspaper circulating generally in the
affected part ofthe local government area.7Public notice of de-amalgamation
polls(1)Theelectoralcommissionmustgivethepublicnoticethateach
de-amalgamation poll will be conducted.(2)The
notice for each de-amalgamation poll must—(a)state—(i)the
polling day for the poll; and(ii)thequestiontobesubmittedtothevotersinthepoll; and(iii)the
affected part of the local government area forthe poll and
that voting at the poll is compulsoryfor the voters
in that area; and(iv)thelocationofallordinarypollingboothstobeused for taking the ballot in the
poll; and(v)thattheordinaryvotinghoursarefrom8a.m.to6p.m; and(b)be
displayed in a conspicuous position at the office ofthe
returning officer for the poll; and(c)be
published in a newspaper circulating generally in theaffected part of the local government
area.(3)Display of a notice under subsection
(2)(b) must—(a)start as soon as practicable after the

3 Voters rolls[s 8](b)continueuntilthecloseofvotingforthede-amalgamation poll.Part
3Voters rolls8Returning officer must compile voters
roll(1)Thereturningofficerforade-amalgamationpollmustcompile a roll
of persons entitled to vote at the poll (avotersroll) as at 8
February 2013 (thecut-off day).(2)The voters roll for a de-amalgamation
poll must consist of thepersons enrolled on an electoral roll
for the affected part of thelocal government
area for the poll.9Requirements of voters roll(1)A voters roll for a de-amalgamation
poll must—(a)show the names of all persons entitled
to vote at the poll;and(b)be
in the form of the electoral roll used for elections ofthe
Legislative Assembly.(2)The returning
officer must not include in a voters roll a voter’saddress that, under theElectoral Act
1992, is excluded fromthe publicly
available part of an electoral roll.10Inspection of voters roll(1)The electoral commission must ensure
the most recent versionof the voters roll for each
de-amalgamation poll is availablefor inspection
by members of the public at the commission’spublic office
for the period—(a)starting as soon as practicable after
the cut-off day forthe poll; and(b)continuing until the result of the poll is

of polling booths(1)There are 3 kinds of polling
booths—(a)ordinary polling booths; and(b)mobile polling booths; and(c)early polling booths.(2)Anordinary polling

part of a building or other structure, that a returning
officerarranges to be available on polling day for
a de-amalgamationpoll to enable voters in general to
vote.(3)Amobile polling
boothis—(a)all or part of
an institution made available as a mobilepolling booth

as a mobile pollingbooth under section 15(4).(4)Anearly polling
boothmeans a place arranged under section16
as a polling booth for voters to cast a pre-poll vote.13Polling booths—general(1)The returning officer for a
de-amalgamation poll—(a)may arrange for
a polling booth within the affected partof the local
government area to be used for the poll; and(b)mayarrangefor2ormorepollingboothsataplacewithin the affected part of the local
government area ifthe number of voters likely to vote at the
place is greaterthan could conveniently vote in 1 booth at
the place; and(c)mustensurethateachpollingboothisprovidedwithenoughballotboxes,ballotpapersandmaterialstoenable voters to mark the ballot
papers.(2)A place on or from which liquor may
lawfully be sold can notbe used as a polling booth.(3)However, a civic or cultural centre,
community hall or similarplace under a local government’s
control, may be used as apolling booth if—(a)the
floor area for taking the ballot is designated in thepolling notice; and(b)the
local government ensures that no liquor will be soldor
supplied in that area during the taking of the ballot.14Provision of ordinary polling
booths(1)For taking a ballot in a
de-amalgamation poll, the returningofficer must
arrange for places, or parts of places, within theaffectedpartofthelocalgovernmentareatobeusedonpollingdayasordinarypollingboothstoenablevotersingeneral to vote.Current as at 8

Arrangements for de-amalgamation polls[s 15](2)The returning officer may, only if it
is necessary because ofcircumstances beyond the returning
officer’s control—(a)arrangeforanordinarypollingboothtobeusedlessthan
3 days before polling day; or(b)cancel arrangements for the use of an
ordinary pollingbooth less than 6 days before polling
day.(3)If, after publication of the polling
notice, the returning officerarranges for the
use of an ordinary polling booth, the officermust also
publish notice—(a)of the location of the booth;
and(b)thattheordinaryvotinghoursofthebootharefrom8a.m. to
6p.m.(4)If the returning officer cancels
arrangements for the use of anordinary polling
booth, the officer must also publish notice ofthe
cancellation.(5)The notice under subsection (3) or (4)
is to be given in theway the returning officer considers is
the best way to informvoters generally.15Declaration of mobile polling booths(1)Subsection (2) applies if the
returning officer is satisfied thevoters resident
in an institution located in the affected part ofthe
local government area for a de-amalgamation poll shouldbe
able to vote in the poll at the institution.(2)Thereturningofficermayarrangeforallorapartoftheinstitution to be available as a
mobile polling booth to enablevoters resident
in the institution to vote there in the poll.(3)Subsection (4) applies if the returning
officer is satisfied a partof the affected
part of the local government area does not haveenough voters to
justify the use of an ordinary polling booth.(4)The
returning officer may arrange for any place in the part ofthe
affected part of the local government area to be availableas a
mobile polling booth to enable voters in the part to vote inthe

undersubsection(2)or(4),theofficer must—(a)fix
the times, during the period starting 11 days beforethe
polling day and ending at 6p.m. on the polling day,when
the mobile polling booth may be used for voting;and(b)publish a
notice, in the approved form, in a newspapercirculatinggenerallyintheaffectedpartofthelocalgovernment
area—(i)declaring the place as a mobile
polling booth forthe de-amalgamation poll; and(ii)stating the
times at which votes may be cast at thebooth.(6)Onthedeclarationofamobilepollingbooth,thevotersresident in the
institution or the voters resident in the part oftheaffectedpartofthelocalgovernmentareainwhichthemobile polling booth is situated, may vote
at the booth duringthe times fixed for the booth under
subsection (5).16Declaration of early polling
booths(1)The returning officer must arrange at
least 1 place, within theaffectedareaofthelocalgovernmentandthattheelectoralcommissioner
considers appropriate, as a polling booth for ade-amalgamation
poll to enable voters to cast a pre-poll vote.(2)Also, the returning officer must—(a)fix the times, during the period
starting 14 days beforethepollingdayandendingat6p.m.onthedayimmediately
before polling day, when the polling boothmay be used for
voting; and(b)publish a notice, in the approved
form, in a newspapercirculatinggenerallyintheaffectedpartofthelocalgovernment

Arrangements for de-amalgamation polls[s 17](i)declaringtheplaceasapollingboothforthede-amalgamationpolltoenablevoterstocastapre-poll vote; and(ii)stating the times at which votes may be cast
at thebooth.17Duty
of person in charge of institution(1)This
section applies if the returning officer declares all or
partofaninstitutionasamobilepollingboothforade-amalgamation poll.(2)Thepersoninchargeoftheinstitutionmustallowvotersresident in the institution and issuing
officers to have access tothe booth whenever votes may be cast
at the booth.18Privacy for voters casting votes at
polling boothsThe returning officer must ensure that each
polling booth for ade-amalgamationpollisprovidedwithenoughvotingcompartments, or other suitable facilities,
to allow the castingof votes in private.19Adjournment of de-amalgamation
poll(1)Areturningofficermayadjourntheconductofade-amalgamation poll at a polling
booth if the taking of thepoll is, or is likely to be,
interrupted by an emergency.(2)Thepresidingofficerforapollingboothmayadjourntheconduct of a de-amalgamation poll at the
polling booth if thetakingofthepollis,orislikelytobe,interruptedbyanemergency.(3)If
the conduct of a de-amalgamation poll is adjourned undersubsection (1) or (2), the returning officer
must fix a day (nolater than 34 days after the day on which
the poll is adjourned)for conducting the adjourned

notice of the day fixed in anewspapercirculatinggenerallyintheaffectedpartofthelocal government area.Division 3Ballot boxes,
ballot papers andother documents20Ballot boxes generally(1)A
ballot box used in a de-amalgamation poll must—(a)have
an opening of a size adequate to allow folded ballotpapers and declaration envelopes to be put
in the box;and(b)be under the
scrutiny and effective control of an issuingofficer.(2)Issuingofficersandobserversforthede-amalgamationpollmay
inspect a ballot box before the box is locked or sealed forreceipt of ballot papers.21Requirements of ballot papersA
ballot paper must—(a)be in the approved form; and(b)show the question for the
de-amalgamation poll; and(c)be of material
that, when folded, effectively conceals thevote recorded on
the ballot paper; and(d)be attached to a
butt that—(i)is not part of the ballot paper;
and(ii)is perforated to
allow the ballot paper to be easilydetached from
the butt; and(iii)isnumberedinregulararithmeticalsequence,startingwiththenumeral1andproceedingbyintervals of one whole numeral, so that each
buttfor the affected area of the local

Arrangements for de-amalgamation polls[s 22]for
which the de-amalgamation poll is conductedhas a unique
number.22Distribution of ballot papers(1)Thereturningofficermustensureanadequatenumberofballotpapersisavailableatallpollingboothsforade-amalgamation
poll.(2)The returning officer must prepare a
delivery note in triplicateforeachparcelofballotpaperssuppliedbythereturningofficer to
presiding officers at polling booths.(3)The
delivery note must—(a)be in the approved form; and(b)showdetailsofthenumberofballotpaperssupplied;and(c)show the range of numbers of the
ballot papers; and(d)includeaformofacknowledgementofreceiptoftheballot papers.(4)Two
copies of the delivery note must be included in the parcelof
ballot papers.(5)Assoonaspracticableafterapresidingofficerreceivesaparcel of ballot papers, the officer
must—(a)checkthecontentsagainstthedetailsshowninthedelivery note;
and(b)complete the particulars prescribed by
the delivery note;and(c)signtheformofacknowledgementincludedinthedelivery
note.(6)Ifthereisadiscrepancybetweenthedetailsshowninthedeliverynoteandthecontentsoftheparcel,thepresidingofficer must
cause a countercheck to be made by—(a)if
an issuing officer is available—the issuing officer; orPage

countercheck must be noted inthe form of
acknowledgement and the form must be signed bythepresidingofficerandthepersonwhomadethecountercheck.(8)The
presiding officer must return 1 copy of the delivery notetothereturningofficerandretaintheothercopyofthedelivery note
until it is given to the returning officer with thesealed parcels of ballot papers under
section 46.Division 4Observers23Expressions of interest to be
observers(1)Thereturningofficerforade-amalgamationpollmay,bynotice in the approved form, call for
expressions of interestfrom persons who wish to be appointed
as observers for thepoll.(2)The
notice must—(a)state the day by which an expression
of interest must bereceived by the returning officer
(theclosing day); and(b)be displayed in a conspicuous position
at the office ofthe returning officer; and(c)be published in a newspaper
circulating generally in theaffected part of
the local government area.(3)Apersonmaymakeanexpressionofinterestinbeingappointedasanobserverforthede-amalgamationpollbygiving the returning officer a notice
in the approved form bythe closing day stated in the
notice.24Appointment of observers(1)The returning officer for a
de-amalgamation poll may, in theapproved form,

poll if the person—(a)is an adult; and(b)made
an expression of interest under section 23(3).(3)The
returning officer must appoint the number of observersforade-amalgamationpolldecidedbytheelectoralcommissioner.25Proof
of identificationAn observer must—(a)carryevidenceofidentificationandoftheperson’sappointment as an observer; and(b)on demand, produce the evidence to an
issuing officer.26Powers of observers(1)Anobserverforade-amalgamationpollisentitledtobepresent—(a)in a
polling booth to inspect ballot boxes at the boothbefore the boxes are locked or sealed for
the receipt ofballot papers; and(b)inapollingboothorotherplacetowatchtheexaminationofdeclarationenvelopesandcountingofvotes.(2)An
observer for a de-amalgamation poll may—(a)objecttoanissuingofficer’sdecisiononaperson’sentitlement to
vote at the poll; and(b)object to the
acceptance or rejection of a ballot paper bythe returning

delaysIfthereisanerror,omissionordelayinorrelatingtothepreparation, issue, sending or return
of any voters roll, ballotpaperorotherdocumentrelevanttotheconductofade-amalgamation poll, it may be
corrected by a gazette noticeby the electoral

following persons are the only persons entitled to vote ata
de-amalgamation poll—(a)persons whose
names are on the voters roll for the poll;(b)persons whose names are not on the voters

area for thepoll but are entitled to be enrolled on the

votes29Ways in which to cast votes(1)In a de-amalgamation poll, a voter
may—(a)cast their vote at an ordinary or
mobile polling booth onpolling day (anordinary
vote); or(b)cast
their vote at an early polling booth before pollingday
(apre-poll vote); or(c)cast their vote using posted voting
papers (apostal vote).(2)Anyvotermaycastanordinaryvoteinade-amalgamationpoll.(3)Any voter may cast a pre-poll vote in
a de-amalgamation poll.(4)A voter may only
cast a postal vote in a de-amalgamation pollif—(a)thevoterwillnotbewithin8km,bythenearestpracticable route, from a polling booth
during ordinaryvoting hours on polling day; or(b)the voter will be working or
travelling under conditionsthatpreventvotingatapollingboothduringordinaryvoting hours on
polling day; or(c)thevoterwillbepreventedfromvotingatapollingboothbecauseofillness,disabilityoradvancedpregnancy;
or(d)thevoterwillbepreventedfromvotingatapollingbooth because
the voter is caring for a person who is ill,has a disability
or is pregnant; or(e)thevoterwillbepreventedfromvotingatapollingbooth for all,

because of membership of a religious orderor because of
religious beliefs.30Who must complete a declaration

poll if—(a)the voter is casting a postal vote;
or(b)the voter’s name is not on the voters
roll—(i)apparently because of an official
error; or(ii)because section
28(1)(c) applies to the voter; or(c)thevoterappears,fromarecordapparentlymadeinerror, to have already voted in the
poll; or(d)the voter is serving a sentence of
imprisonment on thecut-off day for the poll, but is not serving
a sentence ofimprisonment on the polling day for the
poll; or(e)the voter’s address has been omitted
from a voters roll—(i)because of theElectoral Act
1992, section 58; or(ii)underanarrangementundertheElectoralAct1992,section62becauseoftheCommonwealthElectoral Act
1918(Cwlth), section 104; or(f)an
issuing officer gives the voter a declaration envelopeunder section 35(5) because the issuing
officer suspects,on reasonable grounds, that the voter is not
entitled tovote at the de-amalgamation poll.31Casting an ordinary vote or a pre-poll
vote(1)Tocastanordinaryvoteorapre-pollvoteinade-amalgamation poll, a voter must
follow, in order, each ofsubsections (2) to (7) that applies to
the voter.(2)The voter must attend 1 of the
following polling booths duringvoting hours for

cast an ordinary vote in a de-amalgamation poll—apollingboothintheaffectedpartofthelocalgovernment area
for the poll; or(b)tocastapre-pollvoteinade-amalgamationpoll—anearlypollingboothintheaffectedpartofthelocalgovernment area for the poll.(3)At the polling booth, the voter must
give the voter’s full nameand address to an issuing officer at
the booth.(4)Thevotermaybeaskedquestionsbytheissuingofficerinorder for the issuing officer to

ballot paper given to a voter under section 39 or 40 is lostin
transit or is accidentally defaced or destroyed, the

presiding officer at a polling booth is responsible for theproper conduct of voting at the polling
booth and for carryingouttheotherdutiesforade-amalgamationpollthatarerequired by the returning officer.(2)The returning officer—(a)may be the presiding officer at a
polling booth; and(b)must appoint an adult as presiding
officer at each pollingbooth other than the booth at which
the returning officeris the presiding officer.(3)If a person can not act as presiding
officer at a polling booth,thereturningofficer,orsomeoneelsewiththereturningofficer’s
approval, may appoint an adult as presiding officer atthe
booth while the person can not act.(4)Anappointmentundersubsection(2)or(3)mustbeintheapproved form.58Issuing officersAnissuing officeris a member of
the electoral commission’sstaff who is responsible for—(a)giving ballot papers and declaration
