protected plant that is leastconcern wildlife
of the genusMicrosorumif the plant is
takenunder contingent salvage.6Condition on taking least concern
plants undercontingent salvage(1)A
whole protected plant that is least concern wildlife may betakenundercontingentsalvage,duringtheharvestperiod,only
if the following conditions are complied with—(a)the
land from which the plant is taken is being, or willbe,
cleared—(i)forconductinganactivityunderaminingleaseunder theMineral
Resources Act 1989; or(ii)for
a government infrastructure project; or(iii)to
harvest a timber plantation; or(iv)underadevelopmentapprovalundertheSustainable Planning Act 2009;(b)thepersontakingthewholeprotectedplanthasanapproved salvage plan for the
land.(2)In this section—approved salvage
plan, for land, means a plan that—(a)includes the following—(i)a description and map of the
land;(ii)a declaration
from the landholder that the land willbe

required for the development or activityunder an
Act;(v)ifthelanddoesnotincluderemnantvegetationundertheVegetationManagementAct1999—enoughinformationtoshowthatthelanddoesnotincluderemnantvegetationunderthatAct;(vi)ifsubparagraph(v)doesnotapply—enoughinformation to
show that the clearing of the land isauthorisedundertheSustainablePlanningAct2009; and(b)is approved by the chief
executive.government infrastructure projectmeans a project relating totheprovisionofinfrastructureorutilitiesbyorfortheCommonwealth, the State or a local
government carried outunder an Act, including, for
example—(a)theconstructionofafacilityfortelecommunicationsunder theTelecommunications Act 1997(Cwlth); or(b)thecarryingoutofworksonaneasementundertheElectricity Act 1994;
or(c)the construction under theLocal Government Act 1993or
theLocal Government Act 2009of a
road controlledby a local government.7Limitation on application of harvest period
for otherprotected plants(1)Theharvestperiodappliestothetaking,foracommercialpurpose,ofawholeprotectedplantthatisendangeredwildlife,
vulnerable wildlife or near threatened wildlife only ifthe
plant is taken—(a)as a stock plant; or(b)for a bioprospecting activity.Page

taking sandalwood from State land(1)Nomorethan500tofprotectedplantpartsofsandalwoodmay be taken
from all State land, during the harvest period,under all
commercial wildlife harvesting licences.(2)The
portion of the 500t that may be taken under a particularcommercial wildlife harvesting licence is
the weight stated onthe licence for protected plant parts
of sandalwood authorisedto be taken from land that is State
land.(3)Inthissection,areferencetotheprotectedplantpartsofsandalwood does not include—(a)dead material or stumps of sandalwood;
