making and levyingcharges for a relevant area.(2)For making and levying the rates or
charges, part 17A of therepealed 2005 regulation continues to
apply as if the 1993 Acthad not been repealed.(3)Forallpurposes,otherthanthemakingandlevyingoftherates or charges, rates or charges
made and levied under theauthorityofthissectionaretakentohavebeenmadeandlevied under the Act.(4)In this section—adjustedlocalgovernmentmeansanadjustedlocalgovernment under section 159YD of the 1993
Act.indigenousregionalcouncilmeanstheNorthernPeninsulaAreaRegionalCouncilortheTorresStraitIslandRegionalCouncil.new

financial year(1)Subsection (2) applies to a local
government other than a localgovernmentthat,immediatelybefore1July2010,wasacommunitygovernmentundertheCommunityGovernmentAreas
Act.(2)Despite the repeal of the 1993 Act,
the following provisionscontinuetoapplytothelocalgovernmentforpreparingitsPage

that Act for thefinancial year that ended on 30 June
2010—(a)chapter 7, part 8 of the 1993
Act;(b)the repealedLocal Government
Finance Standard 2005,part 4 and part
7, division 6.(3)Subsection(4)appliestoalocalgovernmentthat,immediatelybefore1July2010,wasacommunitygovernment under the Community Government
Areas Act.(4)Despitetherepealofthe1993ActandtheCommunityGovernment Areas Act, the following
provisions continue toapply to the local government for
preparing its annual reportandfinancialstatementsunderthoseActsforthefinancialyear
that ended on 30 June 2010—(a)sections11and37oftheCommunityGovernmentAreas Act;(b)chapter 7, part 8 of the 1993
Act;(c)therepealedLocalGovernment(CommunityGovernment
Areas) Finance Standard 2004, parts 7
and8.(5)In this

this part is aboutThis part makes provision to facilitate the
implementation ofthefollowinglimitedreviewablelocalgovernmentmattersthat
were implemented under section 282A of the Act—(a)achangetotheexternalboundariesofIpswichCityCouncil and Scenic Rim Regional Council
gazetted on11 June 2010;(b)achangetotheexternalboundariesofCookShireCouncilandWujalWujalAboriginalShireCouncilgazetted on 16

this part—current local governmentmeans the local
government for arelevant lot immediately after the transfer
day.former local governmentmeans the local
government for arelevant lot immediately before the transfer
day.relevant lotmeans a lot,
shown on an area map mentioned intheLocalGovernment(Operations)Regulation2010,schedule 1, column 3, that is
transferred from the former localgovernmenttothecurrentlocalgovernmentonthetransferday.transfer

government(1)To remove any doubt, it is declared
that an action started by aformerlocalgovernmentistakentohavebeenstartedbyacurrent local
government.(2)In this section—actionmeans
the performance of a function, or the exercise ofa
power, including the following—(a)an
application about land;(b)the amount of
rate for land on a relevant lot;(c)a
demand for payment of an amount of rate;(d)any
requirement under an Act.4DAssets and public
works on relevant lotTo remove any doubt, it is declared
that the assets and publicworksonarelevantlotbelongtothecurrentlocalgovernment.Example—Any material associated with a road or
bridge is an asset.4EApplication fees(1)This
section applies to a relevant application that had not beendecided by the former local government
immediately beforethe transfer day.(2)As
soon as practicable after the transfer day, the former localgovernmentmustpaythefeereceivedfortherelevantapplication to
the current local government.(3)In
this section—relevant applicationmeans an
application made—(a)before the transfer day; and(b)under an Act or a planning scheme;

relevant lot aboutland in the relevant lot.4FPlanning scheme for relevant
lot(1)Anexistingplanningschemeappliesafterthetransferdayuntilthecurrentlocalgovernmentmakesoramendsaplanning scheme to include the relevant
lot.(2)Theexistingplanningschememustbeimplemented,administered and
enforced by the current local government tothe extent it
relates to the relevant lot as if the existing schemewere
part of a planning scheme for its local government area.(3)In this section—existingplanningschememeansaplanningschemeforarelevant lot made
by the former local government before thetransfer
day.4GReferences in documents to former
local government(1)Areferenceinarelevantdocumenttoaformerlocalgovernment may, as appropriate, be taken to
be a reference tothe current local government.(2)In this section—relevant
documentmeans a document about a relevant
lot.4HDuty to facilitate change in
boundaries(1)Aformerlocalgovernmentandacurrentlocalgovernmentmust
do all acts and things necessary or desirable to help inthe
implementation of a boundary change for a relevant lot.(2)Without limiting subsection (1), the
former local governmentmust give the current local government
the records necessaryto enable compliance with this
