prohibited(1)Subject to subsection (2), the supply
of the following goods isprohibited under section 85 of the
Act—(a)toys;(b)childcarearticles,including,forexample,dummies,pacifiers, teething rings, teething rails,
rattles, bibs, gumsoothers and comforting objects;(c)eatingvesselsandutensils,including,forexample,feeding bottles,
sip or sucking cups, bowls, plates andcutlery.Note—Section85oftheActprovidesfortheMinistermakingordersprohibiting or
restricting the supply of goods or services that, in theMinister’s opinion, are likely to cause
death or injury or adversely affectthe health or
wellbeing of a person.Under section 85(5) of the Act, this
order expires 18 months after theorder commences
and may not be renewed.(2)Subsection (1)
applies only if the goods—(a)contain, or have
a component that contains, more than1% by weight of
the chemical identified by the uniqueChemicalAbstractService(CAS)registrynumber117-81-7,alsoknownasdiethylhexylphthalate(DEHP), di(2-ethylhexyl) phthalate or

<www.cas.org>.(b)are intended for use by children up to
and including 36months of age; and(c)are,oranycomponentofthegoodsmentionedinparagraph (a) is, readily able to be
sucked or chewed bychildren up to and including 36 months of
age.(3)To remove any doubt, this section does
not apply if the goodsare—(a)clothing or footwear; or(b)sporting goods; or(c)flotation aids and aquatic toys for the
specific purpose ofassisting a supervised child to float or
