Fair Trading (Toy-like Novelty Cigarette Lighter) Order 2010 [s 1] Fair Trading (Toy-like Novelty Cigarette Lighter) Order 2010 [reprinted as in force on 5 March 2010] 1 Short title This order may be cited as the Fair Trading (Toy-like Novelty Cigarette Lighter) Order 2010 . 2 Supply of toy-like novelty cigarette lighter prohibited (1) The supply of a toy-like novelty cigarette lighter is prohibited under section 85 of the Act. Note — Section 85 of the Act provides for the Minister making orders prohibiting or restricting the supply of goods or services that, in the Minister’s opinion, are likely to cause death or injury or adversely affect the health or wellbeing of a person. Under section 85(5) of the Act, this order expires 18 months after the order commences and may not be renewed. (2) In this section— toy-like novelty cigarette lighter means a device which is intended to produce a flame to set alight cigarettes, or other combustible material, that— (a) is likely to appeal to a child under 5 years by appearing to be a toy taking into account— (i) the totality of its design; and (ii) the appearance, colour and scale typical of toys; and (b) is unlikely to be recognised as a cigarette lighter by a reasonable adult person.
