Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [s 1] Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [reprinted as in force on 1 January 2009] 1 Short title This notice may be cited as the Nature Conservation (Macropod Harvest Period 2009) Notice 2008 . 2 Commencement This notice commences on 1 January 2009. 3 Macropods to which notice applies This notice applies to the following species (each a harvest macropod )— (a) eastern grey kangaroo ( Macropus giganteus ); (b) red kangaroo ( Macropus rufus ); (c) common wallaroo ( Macropus robustus ). 4 Definitions In this notice— additional weight , for each prescribed part of a harvest macropod, means the additional weight stated in schedule 1, column 2 opposite the prescribed part of the macropod stated in schedule 1, column 1. conservation plan means the Nature Conservation (Macropod) Conservation Plan 2005 . dress , a harvest macropod— (a) means— (i) to skin the macropod; or Reprint 1 effective 1 January 2009 Page 3
Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [s 5] (ii) to remove the head, paws, tail or an internal organ of the macropod; but (b) does not include to process the macropod. fully dressed , in relation to a harvest macropod, means a harvest macropod with all of the following parts removed— (a) the head; (b) the viscera; (c) each of the forelimbs, from the elbow joint; (d) the foot of 1 hind limb, from a point below the tarsal joint; (e) the hind limb, other than the hind limb mentioned in paragraph (d), from a point on the tibia midway between the knee and ankle joints; (f) the tail, not more than 160mm from a point where the underside of the tail joins the body in the external urogenital area. harvest macropod see section 3. prescribed part , of a harvest macropod, means a part of the macropod stated in schedule 1, column 1. relevant region , for a harvest macropod, means each region mentioned and described in schedule 2 for the macropod. viscera means all of the contents of the abdominal and thoracic cavities. 5 References to particular areas In schedule 2— (a) a reference to the area of a former shire named in the schedule is a reference to the area that, immediately before 15 March 2008, was the area of the local government of that name; and (b) a reference to transferring area B is a reference to transferring area B under the Local Government Act 1993 as that Act was in force on 10 August 2007. Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [s 6] Note See the Local Government Act 1993 , section 159YD. 6 Harvest period for harvest macropods (1) A harvest period for a harvest macropod starts, for each relevant region for the macropod, on 1 January 2009 and ends at the end of— (a) if the chief executive has published a notice stating the chief executive is satisfied that, for the year, the relevant maximum amount for the macropod for the region will have been taken by a particular day—the particular day; (b) otherwise—31 December 2009. (2) A notice mentioned in subsection (1)(a) must be published— (a) in a newspaper circulating generally in the State; and (b) on or before the day the harvest period ends. Editor’s note— A copy of a notice published under this section may be inspected on the agency’s website. (3) If the chief executive publishes, or intends to publish, a notice mentioned in subsection (1)(a) for a harvest macropod, the chief executive must also give each holder of a macropod harvesting licence for the macropod a written notice stating— (a) the chief executive is satisfied that the relevant maximum amount for the macropod for a relevant region will have been taken by a particular day; and (b) the harvest period for the macropod for the region ends at the end of that day. (4) The chief executive must give the notice mentioned in subsection (3) at least 7 days before the day the harvest period ends. (5) In this section— estimated population size , for a harvest macropod, for a relevant region for the macropod, means the population size Reprint 1 effective 1 January 2009 Page 5
Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [s 6] Page 6 estimated by the chief executive for the macropod for the relevant region for 2009. macropod harvesting licence means— (a) a commercial wildlife harvesting licence for macropods; or (b) a recreational wildlife harvesting licence for macropods. relevant maximum amount means— (a) for an eastern grey kangaroo— (i) for the central region for the kangaroo—15% of the estimated population size for the kangaroo for the region for the year; or (ii) for the eastern region for the kangaroo—10% of the estimated population size for the kangaroo for the region for the year; or (iii) for the western region for the kangaroo—there will be no take in that region; or (b) for a red kangaroo— (i) for the central region for the kangaroo—19% of the estimated population size for the kangaroo for the region for the year; or (ii) for the eastern region for the kangaroo—10% of the estimated population size for the kangaroo for the region for the year; or (iii) for the western region for the kangaroo—10% of the estimated population size for the kangaroo for the region for the year; or (c) for a common wallaroo— (i) for the central region for the wallaroo—15% of the estimated population size for the wallaroo for the region for the year; or (ii) for the eastern region for the wallaroo—10% of the estimated population size for the wallaroo for the region for the year; or Reprint 1 effective 1 January 2009
Nature Conservation (Macropod Harvest Period 2009) Notice 2008 [s 7] (iii) for the western region for the wallaroo—10% of the estimated population size for the wallaroo for the region for the year. 7 Minimum area for skin of harvest macropod taken for skin only For section 12(2) of the conservation plan, the minimum area for the skin of a harvest macropod taken for its skin only is 0.41m 2 . 8 Minimum weights for carcass of harvest macropod taken for meat only or meat and skin For section 13(2) of the conservation plan, the minimum weight for the carcass of a harvest macropod taken for its meat only or for both its meat and skin is— (a) for the minimum whole weight—20kg; and (b) for the minimum dressed weight— (i) if the macropod is fully dressed—13kg; or (ii) otherwise—13kg plus the additional weight for each prescribed part of the macropod that is in, on or attached to the macropod. 9 Expiry This notice expires on 31 December 2009. Nature Conservation (Macropod Harvest Period 2009) Notice 2008 Schedule 2 Schedule 2 Relevant regions for harvest macropods section 4, definition relevant region Part 1 Eastern grey kangaroo Central region The central region for the eastern grey kangaroo consists of— (a) the areas of the following local governments— Balonne, Barcoo, Blackall Tambo, Bulloo, Flinders, Longreach, McKinlay, Murweh, Paroo, Quilpie, Richmond, Roma and Winton; and (b) the areas of the following former shires— Aramac, Barcaldine, Murilla, Tara, Taroom and Waggamba. Eastern region The eastern region for the eastern grey kangaroo consists of— (a) the areas of the following local governments— Bundaberg, Burdekin, Central Highlands, Charters Towers, Croydon, Etheridge, Gladstone, Isaac, Lockyer Valley, North Burnett, Rockhampton, Somerset, South Burnett, Southern Downs and Toowoomba; and (b) the areas of the following former shires— Banana, Boonah, Bowen, Caboolture, Cardwell, Chinchilla, Herberton, Inglewood, Jericho, Kilkivan, Mirini, Tiaro, Wambo and Woocoo; and (c) transferring area B. Part 2 Red kangaroo Central region The central region for the red kangaroo consists of— (a) the areas of the following local governments— Balonne, Barcoo, Blackall Tambo, Bulloo, Flinders, Longreach, McKinlay, Murweh, Paroo, Quilpie, Richmond, Roma and Winton; and (b) the areas of the following former shires— Aramac, Barcaldine, Murilla, Tara, Taroom and Waggamba.
