Plant Protection (Vegetable Leafminer—Movement Prohibition) Notice 2008 [s 1] Plant Protection (Vegetable Leafminer—Movement Prohibition) Notice 2008 [reprinted as in force on 3 September 2008] 1 Short title This notice may be cited as the Plant Protection (Vegetable Leafminer—Movement Prohibition) Notice 2008 . Note — Under section 9(3) of the Act, this notice remains in force until whichever of the following first happens— (a) the commencement of a regulation under section 9(1) of the Act in relation to the same matter; (b) the end of 3 months. 2 Definitions In this notice— vegetable leafminer means the pest Liriomyza sativae Blanchard. vegetable leafminer pest area means the part of Queensland north of latitude 13º45' south. Note — Latitude 13º45' south passes near Coen. 3 Restriction on moving vegetable leafminer and infested plant (1) A person must not, without an inspector’s approval, move vegetable leafminer or an infested plant— (a) out of the vegetable leafminer pest area; or (b) from a parcel of land in the vegetable leafminer pest area to another parcel of land in the area. Plant Protection (Vegetable Leafminer—Movement Prohibition) Notice 2008 [s 4] (2) An inspector may give an approval, with or without conditions, only if the inspector is satisfied the movement of the vegetable leafminer or infested plant will not pose a significant risk of spreading vegetable leafminer in Queensland. (3) In this section— infested plant means a plant infested with vegetable leafminer. 4 Attachment (1) The attachment to this notice shows the approximate location of the vegetable leafminer pest area.
