Fair Trading (Fire Footbag) Order 2008 [s 1] Fair Trading (Fire Footbag) Order 2008 [reprinted as in force on 25 July 2008] 1 Short title This order may be cited as the Fair Trading (Fire Footbag) Order 2008 . 2 Supply of Fire Footbag prohibited (1) The supply of a Fire Footbag is prohibited under section 85 of the Act. (2) However, subsection (1) does not apply if the supplier knows or believes, on reasonable grounds, that the Fire Footbag is for use by the user only for— (a) the purpose of earning or attempting to earn assessable income; or (b) other professional entertainment purposes. Note — Section 85 of the Act provides for the Minister making orders prohibiting or restricting the supply of goods or services that, in the Minister’s opinion, are likely to cause death or injury or adversely affect the health or wellbeing of a person. Under section 85(5) of the Act, this order expires 18 months after the order commences, and may not be renewed. (3) In this section— assessable income means assessable income under the Income Tax Assessment Act 1997 (Cwlth). Fire Footbag means a product that is— (a) manufactured from fire resistant material; and (b) designed to be doused in flammable liquid, ignited and used for the purpose of amusement by kicking or throwing.
