Local Government (Areas) Regulation 2008 Part 1 Preliminary [s 1] Local Government (Areas) Regulation 2008 [as amended by all amendments that commenced on or before 1 June 2010] Part 1 Preliminary 1 Short title This regulation may be cited as the Local Government (Areas) Regulation 2008 . 2 Commencement This regulation commences on 15 March 2008. Part 2 Local government areas 3 Declaration of local government areas etc. (1) This section and schedule 1 declare the following information about each local government mentioned in schedule 1— (a) its class; (b) its area and any divisions of the area; (c) the assignment of councillors to each division; (d) its composition. (2) A local government’s area, and any divisions of the area, are shown on its area map under schedule 1. (3) Each area map is identified by a map number marked on the map. Local Government (Areas) Regulation 2008 Part 2 Local government areas [s 4] 4 City of Brisbane (1) The electoral wards of the City of Brisbane are named in schedule 2. (2) The external boundaries of the local government area of the City of Brisbane are shown on map LGRB 1 edition 2, sheets 1 to 4. (3) The electoral ward boundaries are shown on map LGRB 1 edition 2, sheets 5 to 30. (4) For each ward, the boundaries are shown on the sheet number of map LGRB 1 edition 2 stated in schedule 2 opposite the ward’s name. 5 Area maps must be available for inspection (1) The chief executive must— (a) keep a copy of the area maps open to inspection; and (b) ensure the following have a copy of its area map— (i) City of Brisbane; (ii) each local government mentioned in schedule 1. (2) The City of Brisbane and each local government must keep a copy of its area map open to inspection. (3) In this section— area map means— (a) for City of Brisbane—the map mentioned in section 4; or (b) for a local government—its area map under schedule 1. Page 4 Reprint 1D effective 1 June 2010
Part 3 Local Government (Areas) Regulation 2008 Part 3 Joint local governments [s 6] Joint local governments 6 Declaration of joint local government area—Act, s 42 The part of the State consisting of the local government areas mentioned in section 2 of a part of schedule 3 is declared to be a joint local government area. 7 Establishment, operation, jurisdiction and membership of joint local government—Act, ss 43–45 and 48 (1) A joint local government is established for each joint local government area. (2) The joint local government has the name stated for the joint local government in section 1 of a part of schedule 3. (3) The number of representatives to which each component local government is entitled on the joint local government is stated in section 3 of the part of the schedule. (4) The joint local government has the jurisdiction stated for the joint local government in section 4 of the part of the schedule. (5) An additional section of the part of the schedule has effect for section 44 of the Act. (6) In this section— additional section means a section other than sections 1 to 4. 8 Existing joint local governments The information included in schedule 3 at the commencement of this part in relation to the Esk–Gatton–Laidley Water Board and the Nogoa River Flood Plain Board is intended only to be declaratory of the information applying to the 2 entities at the commencement of this part. Schedule 3 Local Government (Areas) Regulation 2008 Schedule 3 Information about joint local governments sections 6 and 7 Part 1 Esk–Gatton–Laidley Water Board 1 Joint local government The name of the joint local government is the Esk–Gatton–Laidley Water Board. 2 Area (1) The joint local government area consists of the parts of the local government areas of Lockyer Valley Regional Council and Somerset Regional Council shown on plan JB2 held by the department. (2) A copy of plan JB2 may be inspected, free of charge, during office hours on business days, at the department’s head office. 3 Composition The joint local government is composed of 4 members from Lockyer Valley Regional Council and 2 members from Somerset Regional Council. 4 Jurisdiction The joint local government’s jurisdiction is— (a) to plan, design, manage, construct, operate and maintain the following for the Lowood, Gatton, Laidley Water Supply Scheme— (i) the Brisbane River intake works; Reprint 1D effective 1 June 2010 Page 15
Local Government (Areas) Regulation 2008 Schedule 3 (ii) the Lowood Treatment Plant; (iii) interconnecting pumps and pipework; (iv) storage reservoirs; (v) distribution trunk mains; and (b) to sell water in bulk to Somerset Regional Council and Lockyer Valley Regional Council, at points to be decided by agreement; and (c) to enter into any arrangements that may be necessary for the joint local government to be in a position to sell water in bulk to the Somerset Regional Council and Lockyer Valley Regional Council. Part 2 Nogoa River Flood Plain Board 1 Joint local government The name of the joint local government is the Nogoa River Flood Plain Board. 2 Area (1) The joint local government area consists of the parts of the local government areas of Central Highlands Regional Council and Isaac Regional Council shown on plan JB1 held by the department. (2) A copy of plan JB1 may be inspected, free of charge, during office hours on business days, at the department’s head office. 3 Composition The joint local government is composed of 3 members from Central Highlands Regional Council and 1 member from Isaac Regional Council. Local Government (Areas) Regulation 2008 Schedule 3 4 Jurisdiction The joint local government’s jurisdiction is to manage the Nogoa River flood plain. 5 Appointment of president and deputy president A representative of the Central Highlands Regional Council is the president, and another representative of the Central Highlands Regional Council is the deputy president, of the joint local government. 6 Contributions The cost of the operations of the joint local government must be paid in the following proportions— (a) Central Highlands Regional Council—90%; (b) Isaac Regional Council—10%.
