regulation—DriverLicensingRegulationmeans theTransport Operations(Road Use
Management—Driver Licensing) Regulation 1999.repealedprovisionmeans
either of the following provisionsof the Driver
Licensing Regulation, as in force immediatelybefore the
commencement of section 4—(a)section
29;(b)section 30D.SHOprovisionsmeanspart6CoftheDriverLicensingRegulation.4Appeals started before 29 October
2007(1)This section applies if—(a)before the commencement of this
section, a person haslodgedanappealwithacourtunderarepealedprovision;

the commencement, the appeal has not been decidedor
withdrawn.(2)The appeal is taken to be an
application for a special hardshiporder.(3)Thecourtmusthearanddecidetheappealasifitwereanapplication for a special hardship
order.(4)Forsubsections(2)and(3),theSHOprovisionsapplyinrelation to the application for a
special hardship order as if—(a)the
person who lodged the appeal were eligible to applyfor
the order under section 30U of the Driver LicensingRegulation; and(b)therequirementsundersection30VoftheDriverLicensingRegulationabouttheapplicationhavebeencomplied with; and(c)a
reference to an open or provisional licence in the SHOprovisions included a reference to a
Queensland driverlicenceofthesametypeastheperson’sQueenslanddriverlicenceinrelationtowhichtheappealwaslodged.(5)Also
for subsections (2) and (3), the court may make a specialhardship order for a reason mentioned in
section 30Z(1)(b)(ii)oftheDriverLicensingRegulationeventhoughtheappealwas lodged for a
reason mentioned in section 30Z(1)(b)(i) ofthe Driver
Licensing Regulation.(6)However—(a)despite section 30W of the Driver
Licensing Regulation,thestayoftheperson’sQueenslanddriverlicenceinrelation to which the appeal was lodged
under a repealedprovision continues until the court decides
to make ornot make the special hardship order;
and(b)the court may waive a requirement
under section 30Z(2)or(3)oftheDriverLicensingRegulationthattheapplicantgivethecourtanaffidavitmentionedintheprovision if the
court considers it has all the informationthat would be
provided by the affidavit.Page 4Reprint 1

commencement of thissectionthecourthasfinishedhearingtheappealunderarepealed provision—(a)thecourtmustdecidetheappealundertherepealedprovision as if
the provision had not been repealed; and(b)the
repealed provision continues to apply in relation tothefollowingasiftheprovisionhadnotbeenrepealed—(i)the
stay of the person’s Queensland driver licencein relation to
which the appeal was lodged;(ii)the
court’s decision.(8)Forsubsection(7),acourtisconsideredtohavefinishedhearinganappealunderarepealedprovisiononlyifthecourt—(a)has
heard or received—(i)all the evidence the applicant intends
to produce inrelation to the appeal; and(ii)alltheinformationthechiefexecutiveintendstogive
in relation to the appeal; and(b)hasadjournedthehearingtomakeitsdecisioninrelation to the appeal.5Appeals not started by 29 October
2007(1)This section applies if—(a)before the commencement of this
section, a person wasgiven a written notice under section
25(5) or 30A(2) oftheDrivingLicensingRegulationstatingthattheperson’s licence
is suspended for a stated period startingon a stated day;
and(b)atthecommencement,thepersonhadnotlodgedanappealagainstthesuspensionunderarepealedprovision.(2)The person may apply for, and a court
may make, a specialhardship order as if—Reprint 1

Regulation; and(b)a reference to an open or provisional
licence in the SHOprovisions included a reference to a
Queensland driverlicenceofthesametypeastheperson’sQueenslanddriverlicencethathasbeensuspendedundersection25(8)
or 30A(1) of the Driver Licensing Regulation.(3)The
application for the order must be made in the way statedin
section 30V of the Driver Licensing Regulation, includingwithintheperiodstatedinsection30V(2)(a)ofthatregulation.6Notice giving requirement(1)This section applies if, during the
relevant period, the chiefexecutive gives a person a written
notice under section 25(5)or 30A(2) of the Driving Licensing
Regulation stating that theperson’s licence is suspended for a
stated period starting on astated day.(2)Thenotice,oranotherwrittennoticeaccompanyingthenotice, must inform the person of the effect
of section 5 if theperson does not lodge an appeal against the
suspension undersection 29 or 30D of the Driver Licensing
Regulation beforethe commencement of section 5.(3)Section 5 applies to the person
whether or not the person isinformed of the
matter mentioned in subsection (2).(4)In
this section—relevantperiodmeans
the period—(a)startingatthebeginningofthedaythisregulationisnotified in the gazette; and(b)ending at the end of 28 October
