and(b)isnotanactivityforwhichacollectionauthorityisrequired under theBiodiscovery Act

licencemeans a commercialwildlifeharvestinglicencegrantedundertheNatureConservation(Administration)Regulation2006,section29(1)(a).contingentsalvageseetheNatureConservation(ProtectedPlants)

for leastconcern plants(1)Theharvestperiodappliestothetaking,foracommercialpurpose,ofawholeprotectedplantthatisleastconcernwildlife if the
plant is taken—(a)as a stock plant; or(b)under contingent salvage; or(c)for a bioprospecting activity.(2)Theharvestperiodappliestothetaking,forotherthanacommercial purpose, of a whole
protected plant that is leastconcern wildlife
of the genusMicrosorumif the plant is
takenunder contingent salvage.6Limitation on application of harvest
period for otherprotected plantsTheharvestperiodappliestothetaking,foracommercialpurpose,ofawholeprotectedplantthatisendangeredwildlife, vulnerable wildlife, rare wildlife
or near threatenedwildlife if the plant is taken—(a)as a stock plant; or(b)for a bioprospecting activity.7Condition on taking whole protected
plants undercontingent salvage(1)Awholeprotectedplantmaybetakenundercontingentsalvage,duringtheharvestperiod,onlyifthefollowingconditions are
complied with—(a)the land from which the plant is taken
is being, or willbe, cleared—

theMineral Resources Act 1989;
or(ii)for a government infrastructure
project; or(iii)to harvest a
timber plantation; or(iv)under a
development approval under theIntegratedPlanning Act
1997;(b)thepersontakingthewholeprotectedplanthasanapproved salvage plan for the
land.(2)In this section—approved salvage
plan, for land, means a plan that—(a)includes the following—(i)a description and map of the
land;(ii)adeclarationfromtheland-holderthatthelandwill be
cleared;(iii)adescriptionofthedevelopmentoractivityforwhich
the land will be cleared;(iv)acopyofanynecessarylicence,permitorotherauthority
required for the development or activityunder an
Act;(v)ifthelanddoesnotincluderemnantvegetationundertheVegetationManagementAct1999—enoughinformationtoshowthatthelanddoesnotincluderemnantvegetationunderthatAct;(vi)ifsubparagraph(v)doesnotapply—enoughinformation to
show that the clearing of the land isauthorised under
theIntegrated Planning Act 1997;and(b)is
approved by the chief executive.government
infrastructure projectmeans a project relating totheprovisionofinfrastructureorutilitiesbyorfortheCommonwealth, State or local government
carried out underan Act including, for example—

or(c)the construction of a local government
road under theLocal Government Act 1993.Part 4Limitations and
conditionsapplying to protected plantparts8Limitation on application of harvest period
for particularprotected plant partsThe harvest
period applies to the taking of a protected plantpart
for a plant of the genusMicrosorumif the protected
plantpart is taken—(a)under
salvage; or(b)for a bioprospecting activity.9Condition on taking sandalwood from
State land(1)Nomorethan500tofprotectedplantpartsofsandalwoodmay be taken from
all State land, during the harvest period,under all
commercial wildlife harvesting licences.(2)The
portion of the 500t that may be taken under a particularcommercialwildlifeharvestinglicenceisthevolumestatedonthelicenceforprotectedplantpartsofsandalwoodauthorised to be
taken from land that is State land.(3)Inthissection,areferencetotheprotectedplantpartsofsandalwood does not include—(a)dead material or stumps of sandalwood;
and(b)protected plant parts of sandalwood
taken under salvage.

other land(1)No more than 50t of protected plant
parts of sandalwood maybe taken from all land other than
State land, during the harvestperiod, under all
commercial wildlife harvesting licences.(2)The
portion of the 50t that may be taken under a particularcommercialwildlifeharvestinglicenceisthevolumestatedonthelicenceforprotectedplantpartsofsandalwoodauthorised to be
taken from land that is not State land.(3)Inthissection,areferencetotheprotectedplantpartsofsandalwood does not include—(a)dead material or stumps of sandalwood;
and(b)protected plant parts of sandalwood
