s1 3 s3 Local Government (Toowoomba Water Futures Poll) Regulation 2006 Local Government (Toowoomba Water Futures Poll) Regulation 2006 [reprinted as in force on 12 May 2006] Part 1 Preliminary 1 Short title This regulation may be cited as the Local Government (Toowoomba Water Futures Poll) Regulation 2006 . 2 Definitions In this regulation— commencement means the day this regulation commences. council means Toowoomba City Council. meeting means the meeting of the council held on 21 April 2006. 3 Purposes of regulation The purposes of this regulation are as follows— (a) to provide for particular matters about the preparation of statements, for section 478 1 of the Act, of the case for and against the question to be voted on in a poll— (i) conducted by the council under chapter 6, part 2 of the Act; and (ii) about the addition of purified recycled water to Toowoomba’s water supply; 1 Section 478 (Cases for and against question in poll) of the Act
s4 4 s5 Local Government (Toowoomba Water Futures Poll) Regulation 2006 (b) to prescribe changes relating to the application of chapter 5, part 6 2 of the Act to the poll. Part 2 Provisions about poll 4 Preparation of statements for poll (1) The statement of the case for the question to be voted on in the poll must be prepared by or for the councillors who voted for the question at the meeting. (2) The statement of the case against the question to be voted on in the poll must be prepared by or for the councillors who voted against the question at the meeting. (3) Each statement must— (a) be no more than 1000 words; and (b) be given to the returning officer for the poll within 14 days after the commencement. (4) If the council decides to give an amount to councillors for the preparation of the statements, the council must ensure the same amount is given to each group of councillors mentioned in subsections (1) and (2). 5 Application of particular provisions to poll For section 477(1) 3 of the Act, the following changes to the stated provisions of chapter 5, part 6 of the Act are prescribed for the poll— (a) for applying section 311(3)(b)(ii) and (4)(a), the reference to the names of candidates is a reference to the question to be voted on in the poll, and display of the 2 Chapter 6 (General operation of local governments), part 2 (Polls), and chapter 5 (Local government elections), part 6 (Conduct of elections) of the Act 3 Section 477 (Electoral provisions that apply to a poll) of the Act
s5 5 s5 Local Government (Toowoomba Water Futures Poll) Regulation 2006 notice must start as soon as practicable after the commencement; (b) for applying sections 321(6), 340(5) and 365(1), the returning officer for the poll, instead of advising candidates, must advise each group of councillors mentioned in section 4(1) and (2) of this regulation; (c) for applying sections 330, 331(1) and 333(1), a reference to a candidate for election is a reference to each group of councillors mentioned in section 4(1) and (2) of this regulation; (d) for applying sections 336(10)(b), 341(2)(c), 348(3)(c) and 351(1)(b), a reference to division 11 is a reference to the method of voting stated in the ballot paper for the poll; (e) for applying section 341(2)(a), a reference to stating the names of candidates is a reference to reading out the question; (f) for applying section 360, in section 358, a reference to the election is a reference to the poll and a reference to section 355 is a reference to the method of voting stated in the ballot paper for the poll; (g) for applying sections 363(1)(c)(ii) and (iii), and 366(3)(b) and (4)(d), the presiding officer for a polling booth and the returning officer for the poll must— (i) count the number of votes in favour of the question marked on all formal ballot papers, and keep the ballot papers in a separate parcel; and (ii) count the number of votes against the question marked on all formal ballot papers, and keep the ballot papers in a separate parcel; (h) for applying section 363(1)(d)(i), the written statement must set out, in words and numerals, the number of votes in favour of, and the number against, the question; (i) for applying section 366(2), the returning officer for the poll must ascertain the number of votes in favour of, and the number against, the question;
s5 6 s5 Local Government (Toowoomba Water Futures Poll) Regulation 2006 (j) for applying section 366(5), the returning officer must add together the number of votes in favour of, and the number against, the question; (k) for applying section 367(2), the reference to a vote for a particular candidate is a reference to whether the vote is a vote in favour of or against the question, and the reference to the name of the candidate for whom a vote is counted is a reference to whether the vote is counted as a vote in favour of or against the question; (l) for applying sections 370(2)(b), 372(1) and 379(1), a reference to each person who was a candidate, each candidate or candidates is a reference to the council; (m) for applying section 385(1)(c), the reference to support of, or opposition to, a candidate or a political party is a reference to support of, or opposition to, the question; (n) sections 391 and 404 are about how a person votes at the poll, rather than the candidate for whom a person votes; (o) for applying sections 392, 392A, 394 and 397, a reference to the election period is a reference to the period— (i) starting on the day notice of the poll is given under section 311; and (ii) ending at 6pm on the day of the poll; (p) for applying section 392A(3)(b), a reference to a candidate or candidates is a reference to a councillor or councillors; (q) section 392A(4) has no application; (r) for applying section 407, the reference in section 407(1)(b) to this chapter is a reference to chapter 5 of the Act as applied under section 477(1).
