regulation—commencementmeans the day
this regulation commences.councilmeans Toowoomba
City Council.meetingmeans the meeting
of the council held on 21 April2006.3Purposes of regulationThe
purposes of this regulation are as follows—(a)to
provide for particular matters about the preparation ofstatements, for section 4781of the Act, of the case forand
against the question to be voted on in a poll—(i)conducted by the council under chapter 6,
part 2 ofthe Act; and(ii)abouttheadditionofpurifiedrecycledwatertoToowoomba’s water supply;1Section 478 (Cases for and against

the Act to the poll.Part 2Provisions about
poll4Preparation of statements for
poll(1)The statement of the case for the
question to be voted on in thepoll must be
prepared by or for the councillors who voted forthe
question at the meeting.(2)The statement of
the case against the question to be voted oninthepollmustbepreparedbyorforthecouncillorswhovoted
against the question at the meeting.(3)Each
statement must—(a)be no more than 1000 words; and(b)be given to the returning officer for
the poll within 14days after the commencement.(4)If the council decides to give an
amount to councillors for thepreparationofthestatements,thecouncilmustensurethesame
amount is given to each group of councillors mentionedin
subsections (1) and (2).5Application of
particular provisions to pollFor section
477(1)3of the Act, the following changes to
thestated provisions of chapter 5, part 6 of
the Act are prescribedfor the poll—(a)forapplyingsection311(3)(b)(ii)and(4)(a),thereference to the names of candidates is a
reference to thequestion to be voted on in the poll, and
display of the2Chapter 6 (General operation of local
governments), part 2 (Polls), and chapter 5(Local government
elections), part 6 (Conduct of elections) of the Act3Section 477 (Electoral provisions that
apply to a poll) of the Act

2006noticemuststartassoonaspracticableafterthecommencement;(b)forapplyingsections321(6),340(5)and365(1),thereturningofficerforthepoll,insteadofadvisingcandidates,mustadviseeachgroupofcouncillorsmentioned in
section 4(1) and (2) of this regulation;(c)forapplyingsections330,331(1)and333(1),areferencetoacandidateforelectionisareferencetoeach
group of councillors mentioned in section 4(1) and(2)
of this regulation;(d)forapplyingsections336(10)(b),341(2)(c),348(3)(c)and 351(1)(b), a
reference to division 11 is a referenceto the method of
voting stated in the ballot paper for thepoll;(e)for applying section 341(2)(a), a
reference to stating thenamesofcandidatesisareferencetoreadingoutthequestion;(f)for
applying section 360, in section 358, a reference tothe
election is a reference to the poll and a reference tosection 355 is a reference to the method of
voting statedin the ballot paper for the poll;(g)forapplyingsections363(1)(c)(ii)and(iii),and366(3)(b) and (4)(d), the presiding officer
for a pollingbooth and the returning officer for the poll
must—(i)count the number of votes in favour of
the questionmarked on all formal ballot papers, and keep
theballot papers in a separate parcel;
and(ii)countthenumberofvotesagainstthequestionmarked on all
formal ballot papers, and keep theballot papers in
a separate parcel;(h)for applying section 363(1)(d)(i), the
written statementmustsetout,inwordsandnumerals,thenumberofvotes
in favour of, and the number against, the question;(i)for applying section 366(2), the
returning officer for thepoll must ascertain the number of
votes in favour of, andthe number against, the
question;

2006(j)for applying section 366(5), the
returning officer mustadd together the number of votes in
favour of, and thenumber against, the question;(k)for applying section 367(2), the
reference to a vote for aparticular candidate is a reference to
whether the vote isavoteinfavouroforagainstthequestion,andthereference to the name of the candidate
for whom a voteis counted is a reference to whether the
vote is countedas a vote in favour of or against the
question;(l)forapplyingsections370(2)(b),372(1)and379(1),areferencetoeachpersonwhowasacandidate,eachcandidate or candidates is a reference
to the council;(m)for applying section 385(1)(c), the
reference to supportof, or opposition to, a candidate or a
political party is areference to support of, or opposition to,
the question;(n)sections 391 and 404 are about how a
person votes at thepoll, rather than the candidate for whom a
person votes;(o)forapplyingsections392,392A,394and397,areferencetotheelectionperiodisareferencetotheperiod—(i)starting on the day notice of the poll
is given undersection 311; and(ii)ending at 6pm on the day of the poll;(p)forapplyingsection392A(3)(b),areferencetoacandidate or candidates is a reference
to a councillor orcouncillors;(q)section 392A(4) has no application;(r)forapplyingsection407,thereferenceinsection407(1)(b) to this
chapter is a reference to chapter 5 ofthe Act as
applied under section 477(1).
