the Barker Barambah water supply scheme.highprioritygroupmeansthewaterallocationsintheBBWSS that are stated to be high
priority group in the waterallocations register.mediumprioritygroupmeansthewaterallocationsintheBBWSSthatarestatedtobemediumprioritygroupinthewater allocations register.ROPmeanstheresourceoperationsplan,called‘BurnettBasin Resource
Operations Plan’, that implements theWaterResource (Burnett Basin) Plan 2000.

continued in existence under theGovernmentOwnedCorporationsRegulation2004,section34.3Emergency declaration
(restriction)—Act, s 22(1)Undersection22(2)(a)oftheAct,theholderofawaterallocation in the
medium priority group must not take fromBBWSS, for any
purpose, more than the maximum volume ofwater worked out
using the following formula—V = (A- S - H -
4000) x 0.6 x UTwhere—Vmeans
the maximum volume of water.AmeansthetotaluseablevolumeofwaterinBBWSS,asworked out under the ROP.SmeansthetotaloftheprojectedstoragelossesfromBBWSS, as worked out under the ROP.Hmeans the total volume of water set
aside for the demandsof holders of water allocations in the
high priority group forthe period from the commencement of
this section until thefirst day when SunWater reasonably
expects that the volumeofwaterintheBjelke-PetersenDamwillbelessthan4000ML.Umeansthevolumeofunusedwaterremainingintheholder’s announced allocation.Tmeans the total volume of unused water
remaining in all theannounced allocations of the holders of
water allocations inthe medium priority group.(2)Thevalueforaparameterintheformulamentionedinsubsection (1) is the value, or the value
worked out, based oninformation available to SunWater at, or as
close as possibleto, the commencement of this
section.

(prohibition)—Act, s 22(1)Undersection22(2)(c)oftheAct,theholderofawaterallocationinthemediumprioritygroupisprohibitedfromtaking water from BBWSS, for any purpose, if
there is lessthan 4000ML in Bjelke-Petersen Dam.(2)However,subsection(1)doesnotapplytotheextenttheMinister has approved the supply, by
SunWater, of water to amaximum of 0.1ML a week if—(a)intheMinister’sopinion,awaterallocationholder’sneed for water is
critical; and(b)theholderhasnottakenthetotalvolumeofwaterallowedtobetakenundertheholder’sannouncedallocation.(3)Also,
subsection (1) does not apply to the holder if—(a)theholderhasnottakenthetotalvolumeofwaterallowedtobetakenundertheholder’sannouncedallocation; and(b)theholdertakeswaterunderthefollowingconditionsfrom
the stated reaches of Barambah Creek—(i)at
any time—(A)betweenAMTD189.5andAMTD182(Dudley Sippel
Weir); or(B)betweenAMTD141.6(FicksCrossinggauging station)
and AMTD 85;(ii)if there is a flow of water greater
than 100ML/dayoverJoeSippelWeir—betweenAMTD182andAMTD 159
(confluence with Barker Creek);(iii)subjecttosubsection(4),ifCherbourgwaterholeandMurgonWeirareoverflowingandthereisaflowofwatergreaterthan44ML/dayatAMTD141.6—between AMTD 159 and AMTD

subsection (3)(b)(iii), theholdermuststoptakingwaterfromthestatedreachofBarambahCreekiftheflowofwaterbecomeslessthan20ML/day at AMTD
