notice—bioprospectingactivitymeans
an activity that—(a)is a bioprospecting activity within
the meaning given bytheNatureConservation(ProtectedPlants)Conservation Plan 2000, schedule 3;
and(b)isnotanactivityforwhichacollectionauthorityisrequired under theBiodiscovery Act
2004.harvestperiodmeanstheharvestperioddeclaredundersection 4.protectedplantmeans a plant
that is endangered, vulnerable,rare, near
threatened or least concern wildlife.protectedplantpartincludesthebark,bud,chemical,exudate, flower,
foliage, fruit, gall, genetic material, gum, oil,phyllode,resin,rhizome,root,seed,spore,stem,andanyother structural component or
constituent, of a protected plant.

for leastconcern plants(1)Theharvestperioddoesnotapplytothetaking,foracommercial
purpose, of a whole protected plant that is leastconcern wildlife unless the plant is
taken—(a)for a whole protected plant of a
prescribed genus—(i)as a stock plant; or(ii)for a bioprospecting activity;
or(b)for another whole protected
plant—(i)as a stock plant; or(ii)under salvage; or(iii)for a
bioprospecting activity.(2)The harvest
period does not apply to the taking, for other thana
commercial purpose, of a whole protected plant of the genusMicrosorumunless the plant
is taken under salvage.(3)In this
section—prescribedgenusmeans
the following—(a)Brachychiton;(b)Ficus;(c)Lepidozamia;(d)Livistona;(e)Microsorum.6Limitation on application of harvest
period for otherprotected plantsTheharvestperioddoesnotapplytothetaking,foracommercialpurpose,ofawholeprotectedplantthatis

plant is taken—(a)as a stock plant; or(b)for a bioprospecting activity.7Condition on taking whole protected
plants undersalvage(1)A
whole protected plant may be taken under salvage, duringtheharvestperiod,onlyifthefollowingconditionsarecomplied with—(a)the
land from which the plant is taken is being, or willbe,
cleared—(i)foranactivityconductedunderaminingleaseunder
theMineral Resources Act 1989;
or(ii)for a State infrastructure project;
or(iii)to harvest a
timber plantation; or(iv)under a
development approval under theIntegratedPlanning Act
1997;(b)thepersontakingthewholeprotectedplanthasanapproved salvage plan for the
land.(2)In this section—approvedsalvageplan, for
land, means a plan that—(a)includes the
following—(i)a description and map of the
land;(ii)a declaration from the land-holder
that the land isto be cleared;(iii)adescriptionofthedevelopmentoractivityforwhich
the land is to be cleared;(iv)acopyofanynecessarylicence,permitorotherauthority
required for the development or activityunder an
Act;(v)ifthelanddoesnotincluderemnantvegetationundertheVegetationManagementAct

HarvestPeriod) Notice 20061999—enoughinformationtoshowthatthelanddoesnotincluderemnantvegetationunderthatAct;(vi)ifsubparagraph(v)doesnotapply—enoughinformation to
show that the clearing of the land isauthorised under
theIntegrated Planning Act 1997;and(b)is
approved by the chief executive.Stateinfrastructureprojectmeansaprojectrelatingtoinfrastructure undertaken by the State
under an Act, including,for example—(a)theState Development and Public Works
OrganisationAct 1971; and(b)theTransport
Infrastructure Act 1994.Part 4Limitations and conditionsapplying to protected plantparts8Limitation on application of harvest period
for particularplant partsThe harvest
period does not apply to the taking of a protectedplant
part for a plant of the genusMicrosorumunless the
plantpart is taken—(a)under
salvage; or(b)for a bioprospecting activity.9Condition on taking sandalwood from
State land(1)Nomorethan500tofprotectedplantpartsofsandalwoodmay be taken from
all State land, during the harvest period,under all
commercial wildlife harvesting licences.

taken under a particularcommercialwildlifeharvestinglicenceisthevolumestatedonthelicenceforprotectedplantpartsofsandalwoodauthorised to be
taken from land that is State land.(3)Inthissection,areferencetotheprotectedplantpartsofsandalwood does not include—(a)dead material or stumps of sandalwood;
and(b)protected plant parts of sandalwood
taken under salvage.10Condition on taking sandalwood from
other land(1)No more than 50t of protected plant
parts of sandalwood maybe taken from all land other than
State land, during the harvestperiod, under all
commercial wildlife harvesting licences.(2)The
portion of the 50t that may be taken under a particularcommercialwildlifeharvestinglicenceisthevolumestatedonthelicenceforprotectedplantpartsofsandalwoodauthorised to be
taken from land that is not State land.(3)Inthissection,areferencetotheprotectedplantpartsofsandalwood does not include—(a)dead material or stumps of sandalwood;
and(b)protected plant parts of sandalwood
taken under salvage.Part 5Expiry11ExpiryThis notice
expires on 31 March 2007.
