s1 3 s5 Transport Operations (Passenger Transport) Interim Standard (No. 2) 2005 Transport Operations (Passenger Transport) Interim Standard (No. 2) 2005 [reprinted as in force on 4 January 2006] 1 Short title This standard may be cited as the Transport Operations (Passenger Transport) Interim Standard (No. 2) 2005 . 2 Commencement and expiry (1) This standard commences on 4 January 2006 . (2) This standard expires 6 months after it commences. 3 Definition In this standard— relevant bus means a bus fitted with seat belts for every seated passenger. 4 Application To the extent to which this standard prevents the carriage of standing passengers on a bus, this standard applies despite the Transport Operations (Passenger Transport) Standard 2000 , sections 12(2) and 21(2). 1 5 Operational safety of relevant bus (1) An operator of a relevant bus must take reasonable steps to ensure the bus is used only to carry seated passengers. 1 Transport Operations (Passenger Transport) Standard 2000 , sections 12 (Operational safety of vehicles) and 21 (Ensuring operational safety of vehicles)
s5 4 s5 Transport Operations (Passenger Transport) Interim Standard (No. 2) 2005 (2) Subsection (1) does not apply if carrying a person as a standing passenger on the bus would reduce the person’s exposure to risk, including, for example, because— (a) the person is a child or another vulnerable member of the community; or (b) the person would otherwise be left alone on an isolated or dangerous stretch of road.
