(Interim orders protecting complainant’s interests (tribunal)) of

and(b)statetheordersoughtandthereasonsforseekingtheorder; and(c)be
filed with the tribunal.(2)However, if the
tribunal is satisfied exceptional circumstancesexistinrelationtotheapplication,theapplicationmaybemade orally.5Applicant to give copy of application and
supportingdocuments(1)At
least 2 clear days before the tribunal hears an applicationfor
an order under section 144 or 190 of the Act, the applicantmust
give a copy of the application and any documents filed insupport of the application to the following
persons—(a)the respondent to the
application;(b)for an application made under section
144(1) of the Actby the complainant—the commissioner;(c)for an application made under section
144(1) of the Actby the commissioner—the complainant;(d)for an application made under section
144(2) of the Actby a party to the complaint—the
commissioner;(e)for an application made under section
144(2) of the Actby the commissioner—the party to the
complaint who isnot the respondent to the
application.(2)However, if the tribunal is satisfied
exceptional circumstancesexist in relation to the application,
it may hear the applicationeven if the applicant has not complied
with subsection (1).6Application for order may be heard in
absence ofrespondentIf the tribunal
is satisfied it is in the interests of justice, anapplication for an order under section
144(1) or 190(1) of theActmaybeheardintheabsenceoftherespondenttotheapplication.

section 144 or 190 of theAct, the applicant must promptly give
a copy of the order tothe following persons—(a)the respondent to the
application;(b)for an application made under section
144(1) of the Actby the complainant—the commissioner;(c)for an application made under section
144(1) of the Actby the commissioner—the complainant;(d)for an application made under section
144(2) of the Actby a party to the complaint—the
commissioner;(e)for an application made under section
144(2) of the Actby the commissioner—the party to the
complaint who isnot the respondent to the
application;(f)any other person the tribunal
directs.(2)However, the tribunal may order the
registrar to give a copy ofthe order to a person mentioned in
subsection (1) or may orderthat service on the person be effected

commissioner’s report relating to acomplaint.9Filing and giving referral
documents(1)On referral of a complaint, the
commissioner must file withthe tribunal a referral notice and
referral report in relation tothe
complaint.(2)As soon as practicable after the
notice and report in relation tothe complaint are
filed under subsection (1), the registrar mustgiveacopyofthenoticeandreporttothepartiestothecomplaint.10Referral notice to include addresses for
serviceA referral notice for a complaint must set
out the followinginformation in relation to a
complaint—(a)aparty’saddressforserviceasnotifiedtothecommissioner under the Act;(b)if a party to the complaint has given
the commissionernoticeofachangeintheparty’saddressforserviceunder section
263E(1)3of the Act, the changed addressfor
service.11Referral report not to include
particular informationNothingsaidordoneinthecourseofconciliationofacomplaint may be included in the
referral report in relation tothe

conference(1)This section applies if the tribunal
orders a person to conferwith a member of the tribunal under

process13Giving order for attendance at hearing
and evidence(1)As soon as practicable after the
tribunal makes an order undersection
201(1)5of the Act in relation to a person,
the partywho applied for the order must give a copy
of it to the person.(2)However, the tribunal may order the
registrar to give a copy ofthe order to the person or may order
that service on the personbe effected in a particular

gives written reasons for a decision in relationto a
proceeding, the registrar must, as soon as practicable afterthe
reasons have been given, give a copy of the reasons to—(a)the parties to the proceeding;

inspection of documents;(c)the place, date,
time and method of hearing;(d)whether a witness
in a hearing is to give evidence—(i)orally or by signed written statement, or
both; or(ii)orally or by affidavit, or

specifiedprovision of Act—Act, s 113An
application under section 1137of
the Act for an exemption,or renewal of an exemption, from the
operation of a specifiedprovision of the Act must—(a)be made in the approved form setting
out—(i)the provision of the Act from which an
exemptionis sought; and(ii)theperiod,orfurtherperiod,forwhichtheexemption is sought; and(iii)the
person, people or class of people for whom theexemption is
sought; and(iv)astatementofthegroundsonwhichtheapplication is made; and(b)be
accompanied by a statement made by, or on behalf of,the
applicant setting out detailed information in supportof
the application; and(c)be signed by, or on behalf of, the
applicant; and(d)be filed with the tribunal.18Application to review decision that
complaint haslapsed—Act, s 169(1)An
application under section 169(3)8of
the Act to review thecommissioner’s decision that a
complaint has lapsed must—(a)be in writing;
and(b)beaccompaniedbyastatementmadebythecomplainantthatincludesthereasonswhythecommissioner’s decision should be

1910s 21Anti-Discrimination Tribunal Rule 2005(2)Before the tribunal decides the
application, the registrar mustgive reasonable
written notice of the application to—(a)the
respondent; and(b)the commissioner.19Non-contentious matters—Act, s 257A(1)Forsection257A9oftheAct,thefollowingarenon-contentious matters—(a)a
matter in relation to a provision of the Act stated inschedule 1;(b)amatterinrelationtoanorderordirectionaboutamatter mentioned in section 16(a),
(b), (c), (d) or (e).(2)However, a matter
in relation to a provision of the Act statedin schedule 1 is
not a non-contentious matter if a party to theproceeding
advises the registrar of an objection to the matterbeing
dealt with by the registrar.20Change of address for service(1)If a party to a complaint advises the
tribunal, under section263E(2)oftheAct,ofachangeintheparty’saddressforservice, the registrar must notify all
the parties of the changein that party’s address.(2)Subsection (1) does not affect section
263E of the Act.21Forms(1)The
president of the tribunal may approve forms for use underthis
